Ours has been called a global "age of rights," an era in which respect for human rights is considered the highest aspiration of the international democratic community. Since the United Nation's 1948 Universal Declaration of Human Rights, a wide variety of protections—civil, political, economic, social, and cultural—have been given legal validation as countries ratify treaties, participate in intergovernmental organizations, and establish human rights tribunals and truth and reconciliation commissions.

Yet notable human rights failures have marred the post-Declaration era, including ongoing state violence toward citizens, the selectivity of humanitarian intervention (evidenced by the international community's failure to respond in Rwanda), and recent legislation in advanced democracies that trades some rights for protection against the threat of terrorism. How are we to reconcile the language of rights with the reality? Do we live in an age of rights after all?

In Protecting Human Rights, Todd Landman provides a unique quantitative analysis of the marked gap between the principle and practice of human rights. Applying theories and methods from the fields of international law, international relations, and comparative politics, Landman examines data from 193 countries over 25 years (1976-2000) to assess the growth of the international human rights regime, the effect of law on actual protection, and global variation in human rights norms.

Landman contends that human rights foreign policy remains based more on geo-strategic interest than moral internationalism. He argues that the influence human rights ideals have begun to have on states cannot be separated from the broader impact of socioeconomic changes that swept the globe in the late twentieth century. Landman concludes that international law alone will not suffice to fully protect human rights—it must be accompanied by democratic government, effective conflict resolution, and just economic systems.

The just war tradition is central to the practice of international relations, in questions of war, peace, and the conduct of war in the contemporary world, but surprisingly few scholars have questioned the authority of the tradition as a source of moral guidance for modern statecraft. Just War: Authority, Tradition, and Practice brings together many of the most important contemporary writers on just war to consider questions of authority surrounding the just war tradition.

Authority is critical in two key senses. First, it is central to framing the ethical debate about the justice or injustice of war, raising questions about the universality of just war and the tradition’s relationship to religion, law, and democracy. Second, who has the legitimate authority to make just-war claims and declare and prosecute war? Such authority has traditionally been located in the sovereign state, but non-state and supra-state claims to legitimate authority have become increasingly important over the last twenty years as the just war tradition has been used to think about multilateral military operations, terrorism, guerrilla warfare, and sub-state violence. The chapters in this collection, organized around these two dimensions, offer a compelling reassessment of the authority issue’s centrality in how we can, do, and ought to think about war in contemporary global politics.

What obligations do nations have to protect citizens of other nations? As responsibility to our fellow human beings and to the stability of civilization over many years has ripened fully into a concept of a "just war," it follows naturally that the time has come to fill in the outlines of the realities and boundaries of what constitutes "just" humanitarian intervention.

The Roman Catholic Church's first significant legislative enactment on the nature and role of the Catholic university, the apostolic constitution Ex corde Ecclesiae (1990) grew out of thirty years of dialogue between ecclesiastical authorities and academic representatives. The final document affirms the explicit Catholic identity of Catholic educational institutions and outlines provisions for maintaining that identity; the questions of how to implement its provisions have in turn created the need for more dialogue and examination. In this volume, distinguished scholars and legal experts define the key questions and explore the future implications of Ex corde for American Catholic colleges and universities.

The assertion of the Catholic identity of Catholic institutions of higher education prompts the contributors to examine the definition of Catholic education as a special synthesis of the religious and the academic, of faith and reason; and to discuss corollary issues such as secularization; the counter-cultural features of Catholic education; and the great diversity of such schools in the United States and of their sponsoring religious orders. The contributors probe the schools' relationships with the Church hierarchy, exploring in particular the role of the bishops, the degree of autonomy from ecclesiastical control, and questions of academic freedom. They also consider specific legal issues that American Catholic colleges must face, including recognition of student groups, tenure and promotion decisions, governance, student and faculty conduct, and the relationship between canon and civil law, including compliance with national and local civil rights provisions. This volume also includes the complete text in English of Ex corde Ecclesiae and the preliminary draft of ordinances from the Ex corde Ecclesiae Implementation Committee of the National Conference of Catholic Bishops.

In the aftermath of the September 11, 2001, terrorist strikes, the United States and other liberal democracies were forced to grapple once again with the issue of balancing national security concerns against the protection of individual civil and political rights. This question was particularly poignant when US forces took prisoners in Afghanistan and Iraq who arguably had information about additional attacks. In this volume, ethicist Paul Lauritzen takes on ethical debates about counterterrorism techniques that are increasingly central to US foreign policy and discusses the ramifications for the future of interrogation.

Lauritzen examines how doctors, lawyers, psychologists, military officers, and other professionals addressed the issue of the appropriate limits in interrogating detainees. In the case of each of these professions, a vigorous debate ensued about whether the interrogation policy developed by the Bush administration violated codes of ethics governing professional practice. These codes are critical, according to Lauritzen, because they provide resources for democracies and professionals seeking to balance concerns about safety with civil liberties, while also shaping the character of those within these professional guilds.

This volume argues that some of the techniques used at Guantánamo Bay and elsewhere were morally impermissible; nevertheless, the healthy debates that raged among professionals provide hope that we may safeguard human rights and the rule of law more effectively in the future.

The editors and a sterling list of contributors look at policymaking in the 1990s through the present—providing a comparative politics framework—stressing both parallel development and the differences between and among the nations. Similar prevailing ideas and political factors can be identified and transatlantic comparisons made—providing for a clearer understanding of the policymaking process.

Faith in regulated markets and the burden of rising welfare costs are concerns found on both sides of the Atlantic. Western democracies also share political climates colored by economic austerity; low trust in government, pressures from interest groups, and a sharply divided electorate. Because of differing political processes and differing policy starting points, a variety of disparate policy decisions have resulted.

Real world policymaking in the areas of welfare, health, labor, immigration reform, disability rights, consumer and environmental regulation, administrative reforms, and corporate governance are compared. Ultimately, the last decade is best characterized as one of "drift," sluggish changes with little real innovation and much default to the private sector. In general, policymakers on both sides of the ocean, constrained by economic necessity, have been unable to produce policy outcomes that satisfy the key segments of the electorate.

The contributors examine the United States, Great Britain, France, and Germany, as well as a number of other European countries, and study the European Union itself as a policymaking institution. Transatlantic Policymaking in an Age of Austerity distills the prominent issues, politics, and roles played by governmental institutions into a new understanding of the dynamics of policymaking in and among transatlantic nations.

During the past decade, Democrats and Republicans each have received about fifty percent of the votes and controlled about half of the government, but this has not resulted in policy deadlock. Despite highly partisan political posturing, the policy regime has been largely moderate. Incremental, yet substantial, policy innovations such as welfare reform; deficit reduction; the North American Free Trade Agreement; and the deregulation of telecommunications, banking, and agriculture have been accompanied by such continuities as Social Security and Medicare, the maintenance of earlier immigration reforms, and the persistence of many rights-based policies, including federal affirmative action.

In Seeking the Center, twenty-one contributors analyze policy outcomes in light of the frequent alternation in power among evenly divided parties. They show how the triumph of policy moderation and the defeat of more ambitious efforts, such as health care reform, can be explained by mutually supporting economic, intellectual, and political forces. Demonstrating that the determinants of public policy become clear by probing specific issues, rather than in abstract theorizing, they restore the politics of policymaking to the forefront of the political science agenda.

Providing intergenerational goods, ranging from balanced budgets to space programs and natural environments, is particularly challenging because most political incentives reward short-term behavior. Lowry examines the effect of institutional structure on the public delivery of these goods. He offers a theoretical framework accounting for both the necessary conditions — public demand, political stability, and official commitment to long-term delivery — and constraining factors — the tensions between public agencies and politicians as well as between different levels of government — that determine the ability of a nation to achieve long-term goals.

In support of this argument, Lowry evaluates data on park systems from more than one hundred countries and provides in-depth case studies of four — he United States, Australia, Canada, and Costa Rica — to show how and why the delivery of intergenerational goods can vary. For each of the cases, he reviews background information, discusses constraints on agency behavior, and assesses expansion of the park systems and restoration of natural conditions at specific locations.

This extensive comparative analysis of the preservation of public lands offers new insights into the capability of nations to pursue long-term goals.

The politics of building dams and levees and other structures are just part of the policies determining how American rivers are managed or mismanaged. America's well-being depends upon the health of those rivers and important decisions go beyond just dam-building or dam removal. American rivers are suffering from poor water quality, altered flows, and diminished natural habitat. Current efforts by policymakers to change the ways American rivers are managed range from the removal of dams to the simulation of seasonal flows to the restoration of habitat, all with varying degrees of success.

Efforts to restore American rivers are clearly delineated by William Lowry in Dam Politics as he looks at how public policy and rivers interact, examines the physical differences in rivers that affect policies, and analyzes the political differences among the groups that use them. He argues that we are indeed moving into an era of restoration (defined in part as removing dams but also as restoring the water quality, seasonal flows, and natural habitat that existed before structural changes to the rivers), and seeks to understand the political circumstances that affect the degree of restoration.

Lowry presents case studies of eight river restoration efforts, including dam removals on the Neuse and Kennebec rivers, simulation of seasonal flows on the Colorado river, and the failed attempt to restore salmon runs on the Snake river. He develops a typology of four different kinds of possible change—dependent on the parties involved and the physical complexity of the river—and then examines the cases using natural historical material along with dozens of interviews with key policymakers. Policy approaches such as conjunctive water management, adaptive management, alternative licensing processes, and water marketing are presented as possible ways of using our rivers more wisely.

Dam Politics provides a useful and systematic account of how American waterways are managed and how current policies are changing. American rivers are literally the lifeblood of our nation. Lowry has written a lively and accessible book that makes it clear as a mountain stream that it matters deeply how those rivers are managed.
