Administering Justice examines the leadership role of chief justices in the American states, including how those duties require chief justices to be part of the broader state political environment. Vining and Wilhelm focus extensively on the power of chief justices as public spokespersons, legislative liaisons, and reform leaders. In contrast to much existing research on chief justices in the states, this study weighs their extrajudicial responsibilities rather than intracourt leadership. Since 1940, more than half of all states have switched at least in part from popular election or elite appointment to experiment with merit selection in choosing some or all of their state supreme court justices. Under merit selection, a commission—often comprising some combination of judges, attorneys, and the general public—is tasked with considering applications from candidates vying to fill a judicial vacancy. Ostensibly, the commission forwards the best candidates to the governor, who ultimately appoints them. Presently, numerous states are debating whether to adopt or abolish merit selection.
In his short, sharp book, Choosing State Supreme Court Justices, Greg Goelzhauser utilizes new data on more than 1,500 state supreme court justices seated from 1960 through 2014 to answer the question, Does merit selection produce better types of judges? Over several decades, many U.S. states abandoned the practice of selecting their judges by direct popular election and adopted the Missouri Plan of judicial selection. In From Ballot to Bench, Philip L. Dubois subjects the various criticisms raised against judicial elections to a more searching scrutiny than previously has been attempted.
Dubois carefully reviews the three central counts on which judicial elections have been faulted: for lowering the quality of the bench, for impairing judicial independence, and for failing to secure judicial accountability. After concluding that the potential for judicial elections to hold judges popularly accountable is what might commend them over alternative selection methods, Dubois concentrates on the analysis of empirical evidence to evaluate judicial elections as mechanisms of accountability.
The study examines all the statewide partisan and nonpartisan elections for state supreme court justices in non-southern states from 1948 to 1974. Included is a detailed examination of voter participation, electoral competition, the behavior of judicial electorates, and the patterns of gubernatorial vacancy appointments. An analysis of decision making on eight state supreme courts also tests the relationship between different selection systems and judicial behavior.
Dubois finds that partisan elections maximize voter participation, meaningfully structure voter choices, minimize accession to the bench by appointment, and allow popular control over gubernatorial appointments. Additional evidence on the extent of partisan voting by judges selected under different methods leads Dubois to conclude that partisan elections are superior to both nonpartisan elections and nonelective selection methods as instruments of accountability.
The importance of the questions addressed, the breadth of the data collected, and the unorthodox conclusions offered make this a significant book for political scientists, judges, lawyers, and public officials.
The struggle for civil rights among black Americans has moved into the voting booth. How such a shift came about—and what it means—is revealed in this timely reflection on black presidential politics in recent years.
Since 1984, largely as a result of Jesse Jackson’s presidential bid, blacks have been galvanized politically. Drawing on a substantial national survey of black voters, Katherine Tate shows how this process manifested itself at the polls in 1984, 1988, and 1992. Barack Obama’s presidential victory naturally led people to believe that the United States might finally be moving into a post-racial era. Obama’s Race—and its eye-opening account of the role played by race in the election—paints a dramatically different picture.
The authors argue that the 2008 election was more polarized by racial attitudes than any other presidential election on record—and perhaps more significantly, that there were two sides to this racialization: resentful opposition to and racially liberal support for Obama. In the United States, almost 90 percent of state judges have to run in popular elections to remain on the bench. In the past decade, this peculiarly American institution has produced vicious multi-million-dollar political election campaigns and high-profile allegations of judicial bias and misconduct. The People’s Courts traces the history of judicial elections and Americans’ quest for an independent judiciary—one that would ensure fairness for all before the law—from the colonial era to the present.
In the aftermath of economic disaster, nineteenth-century reformers embraced popular elections as a way to make politically appointed judges less susceptible to partisan patronage and more independent of the legislative and executive branches of government. This effort to reinforce the separation of powers and limit government succeeded in many ways, but it created new threats to judicial independence and provoked further calls for reform. Merit selection emerged as the most promising means of reducing partisan and financial influence from judicial selection. It too, however, proved vulnerable to pressure from party politics and special interest groups. Yet, as Shugerman concludes, it still has more potential for protecting judicial independence than either political appointment or popular election.
The People’s Courts shows how Americans have been deeply committed to judicial independence, but that commitment has also been manipulated by special interests. Post-Truth Rhetoric and Composition is a timely exploration of the increasingly widespread and disturbing effect of “post-truth” on public discourse in the United States. Bruce McComiskey analyzes the instances of bullshit, fake news, feigned ethos, hyperbole, and other forms of post-truth rhetoric employed in recent political discourse.
The book frames “post-truth” within rhetorical theory, referring to the classic triad of logos, ethos, and pathos. McComiskey shows that it is the loss of grounding in logos that exposes us to the dangers of post-truth. As logos is the realm of fact, logic, truth, and valid reasoning, Western society faces increased risks—including violence, unchecked libel, and tainted elections—when the value of reason is diminished and audiences allow themselves to be swayed by pathos and ethos. Evaluations of truth are deferred or avoided, and mendacity convincingly masquerades as a valid form of argument.
In a post-truth world, where neither truth nor falsehood has reliable meaning, language becomes purely strategic, without reference to anything other than itself. This scenario has serious consequences not only for our public discourse but also for the study of composition.

The assumptions that military service helps candidates attract votes—while lacking it harms a candidate’s chances—has been an article of faith since the electoral coronation of George Washington in 1789. Perhaps the most compelling fact driving the perception that military service helps win votes is the large number of veterans who have held public office. Some candidates even exaggerate their military service to persuade voters. However, sufficient counter-examples undermine the idea that military veterans enjoy an advantage when seeking political office.

He describes the veteran candidate phenomenon by examining the related factors and patterns, showing why different eras have more former generals running and why the number of veterans in election cycles varies. Those who do not have their heads buried too deeply in partisan sands will know that there is something awry with the American form of electoral democracy. Florida's continuing ability to misplace votes recently and in the 2000 Presidential election is only part of the iceberg we have been made privy to-and Steven Schier takes a good, hard, evaluative look not only at what is there in plain sight, but that which lurks below the surface (and not only in Florida and not only with the electoral college). He further proposes practical improvements that will make our surprisingly peculiar democratic processes healthy, whole, and responsive again.
Identifying four essential evaluative criteria for a democracy that genuinely works, Schier asks us to examine the degree to which our system promotes political stability, the degree to which our elected officials are held accountable, what the problems are with voter turnout and how to improve it, and asks for a meaningful scrutiny of governmental policy.
No look at our peculiar democracy would be complete without an examination of other established democracies, nor a look at how special interests warp political parties and the concept of majority rule. The solution to many of our electoral problems, Schier argues, lies in enhancing the roles and influence of political parties. Schier proposes reforms that include broadening voter registration; giving parties large blocks of free TV time; adopting one-punch partisan ballots, making it easier for voters to cast a straight-party vote; abandoning initiatives which clutter up the ballot; and utilizing party-based financing to boost voter turnout. With these proposals, he encourages the creative consideration of election reform, and shows how the Florida 2000 race may have played out had these suggestions been in place.
