While most philosophers who write about punishment ask, "Why may we punish the guilty?" Jacob Adler asks, "To what extent does a guilty person have a duty to submit to punishment?" He maintains that if we are to justify any system of punishment by the state, we must explain why persons guilty of an offense are morally bound to submit to punitive treatment, or to undertake it on their own. Using Rawls's theory of social contract as a framework, the author presents what he calls the rectification theory of punishment.
After examining punishment from two points of view—that of the punisher and that of the offender who is to be punished—Adler proposes the Paradigm of the Conscientious Punishee: a repentant wrongdoer who views punishment as not necessarily unpleasant, but as something it is morally incumbent upon one to undertake. The author argues that this paradigm must play a central role in the theory of punishment. Citing community service projects and penances for sin (as required by some religions), Adler argues that punishment need not involve pain or any other disvalue. Instead he defines it in terms of its justificatiory connection with wrongdoing: punishment is that which is justified by the prior commission of an offense and generally not justified without the prior commission of an offense.
The rectification theory applies particularly to offenses involving basic liberties. It is based on the assumption that each person is guaranteed the right to an inviolable sphere of liberty. Someone who commits an offense has expanded his or her sphere by arrogating excess liberties. In order to maintain the equality on which this theory rests, an equivalent body of liberties must be given up. In discussing applications of the theory, Adler demonstrates that active service (as punishment) is more effective in safeguarding important rights and interests and maintaining the social contract than is afflictive punishment.
Between 1875 and 1920, Chicago's homicide rate more than quadrupled, making it the most violent major urban center in the United States--or, in the words of Lincoln Steffens, "first in violence, deepest in dirt." In many ways, however, Chicago became more orderly as it grew. New Orleans in the 1920s and 1930s was a deadly place. In 1925, the city’s homicide rate was six times that of New York City and twelve times that of Boston. Jeffrey S. Adler has explored every homicide recorded in New Orleans between 1925 and 1940—over two thousand in all—scouring police and autopsy reports, old interviews, and crumbling newspapers. More than simply quantifying these cases, Adler places them in larger contexts—legal, political, cultural, and demographic—and emerges with a tale of racism, urban violence, and vicious policing that has startling relevance for today.
Murder in New Orleans shows that whites were convicted of homicide at far higher rates than blacks leading up to the mid-1920s. But by the end of the following decade, this pattern had reversed completely, despite an overall drop in municipal crime rates. The injustice of this sharp rise in arrests was compounded by increasingly brutal treatment of black subjects by the New Orleans police department. Adler explores other counterintuitive trends in violence, particularly how murder soared during the flush times of the Roaring Twenties, how it plummeted during the Great Depression, and how the vicious response to African American crime occurred even as such violence plunged in frequency—revealing that the city’s cycle of racial policing and punishment was connected less to actual patterns of wrongdoing than to the national enshrinement of Jim Crow. Cost-benefit analysis (CBA) has been an important policy tool of government since the 1980s, when the Reagan administration ordered that all major new regulations be subjected to a rigorous test of whether their projected benefits would outweigh their costs. Not surprisingly, CBA has been criticized by many who claim that it neglects, especially on the benefit side, important values that are hard to measure.
In this book, the authors reconceptualize cost-benefit analysis, arguing that its objective should be overall well-being rather than economic efficiency. They show why the link between preferences and well-being is more complicated than economists have thought. Satisfying a person's preference for some outcome is welfare-enhancing only if he or she is self-interested and well-informed. Also, cost-benefit analysis is not a super-procedure but simply a way to identify welfare-maximizing policies. A separate kind of analysis is required to weigh rights and equal treatment.
This book not only places cost-benefit analysis on a firmer theoretical foundation, but also has many practical implications for how government agencies should undertake cost-benefit studies.
Law and the Living Colorado River asserts that the so-called Law of the River—the vast assemblage of interstate compacts, international treaties, federal and state statutes, regulations, contracts, and other legal documents governing use and management of the Colorado River—ignores the needs of the river as a nested system of aquatic and aquatic-dependent ecosystems. Although society now recognizes and appreciates the natural values of the Colorado River, the Law of the River remains fixed in service of human economies like irrigation and hydropower. Robert W. Adler contends that the law must respond to changing values that prioritize natural systems alongside human ones. He proposes acknowledging the legal rights of the river itself, following the recent movement to recognize rights of nature in other ecosystems around the world. Recognizing that U.S. law has significant barriers to that proposal, however, Adler borrows from aspects of international water law to propose as a shorter-term strategy amendments to the Colorado River Compact that would enhance protection of the river’s environmental needs and values.

Required by one of Oregon’s nineteen statewide planning goals, a boundary in the Portland metropolitan area was intended to separate urban land and land that would be urbanized from commercially productive farmland. After adopting the goals, approving the Portland growth boundary in 1979 was the most significant decision the Oregon Land Conservation and Development Commission has ever made, and, more broadly, is a significant milestone in American land-use planning.
Planning the Portland Urban Growth Boundary primarily covers the 1970s. Innovative regional planning institutions were established in response to concerns about sprawl, but planners working for those institutions had to confront the reality that various plans being developed and implemented by city and county governments in metro Portland would instead allow sprawl to continue. Regional planners labeled these as “Trend City” plans, and sought to transform them during the 1970s and thereafter.
Adler discusses the dynamics of these partially successful efforts and the conflicts that characterized the development of the Portland UGB during the 1970s—between different levels of government, and between public, private, and civic sector advocates. Super Creatures of the Huron River aims to teach children about stream ecology, with a focus on the fascinating “bugs” that can be found in the Huron River. State and national inventories record one hundred dams on the Huron River system, which is typical of rivers and tributaries in the Great Lakes Basin. What was once a free-flowing system is now interrupted by dams on both the river’s main stem and its tributaries. Although dams can provide some benefits, they produce severe negative impacts on the rivers they harness. Dams alter a river’s chemical, physical, and biological processes, including fragmenting and blocking the natural movement of fish and other aquatic species. Although these negative impacts have become more obvious over the past two decades, the environmental costs of dams have only recently captured scientific attention.
Super Creatures of the Huron River is a project conducted by a team of University of Michigan (UM) faculty and students, in collaboration with Huron River Watershed Council (HRWC) researchers. A literary cabinet of curiosities.
Aelian’s Historical Miscellany is a pleasurable example of light reading for Romans of the early third century. Offering engaging anecdotes about historical figures, retellings of legendary events, and enjoyable descriptive pieces—in sum: amusement, information, and variety—Aelian’s collection of nuggets and narratives could be enjoyed by a wide reading public. A rather similar book had been published in Latin in the previous century by Aulus Gellius; Aelian is a late, perhaps the last, representative of what had been a very popular genre.
Here then are anecdotes about the famous Greek philosophers, poets, historians, and playwrights; myths instructively retold; moralizing tales about heroes and rulers, athletes and wise men; reports about styles in dress, food and drink, lovers, gift-giving practices, entertainments, religious beliefs and death customs; and comments on Greek painting. Some of the information is not preserved in any other source. Underlying it all are Aelian’s Stoic ideals as well as this Roman’s great admiration for the culture of the Greeks (whose language he borrowed for his writings).
The Historical Miscellany is now added to the Loeb Classical Library, the Greek text facing a skillful and helpfully annotated new translation by Nigel Wilson. In his trenchant Introduction he discusses the literary genre of Aelian’s miscellany, its style and historical setting.
Three tactical treatises.
Aeneas was perhaps a general, and certainly author of several didactic military works of which the sole survivor is that on defense against siege. From it we can deduce that he was a Peloponnesian of the fourth century BC who served in the Aegean and in Asia Minor and composed the work from direct knowledge and from oral and some literary tradition, possibly in 357–6 BC. It is devoted entirely to defense of fortified places and deals specially with use of defending troops; defensive positions; morale; resistance to attacks and to actual assault; guards; obviation of treachery and revolution; and other subjects.
Asclepiodotus, philosopher and pupil of the Stoic Posidonius, wrote a rather dry but ordered work on tactics as if a subject of the lecture room, based not on personal experience but on earlier manuals. His main subjects were the branches of a military force; infantry; cavalry; chariots; elephants; arms; maneuvers; military evolutions; marching formation. The work ends with words of command.
Onasander (Onasandros), a Platonic philosopher, dedicated his work “The General” to the Roman Veranius, who was a consul in AD 49. The work deals in plain style with the sort of morals and social and military qualities and attitudes expected of a virtuous and militarily successful general. It is also concerned with such matters as his choice of staff; attitude to war; religious duties; military formations; conduct in allied and hostile lands; difficult terrains; camps; drill; spies; guards; deserters; battle formations and maneuvers; and other matters, ending with conduct after victory.
An adversarial advocate.
Aeschines, orator and statesman of Athens, 390 or 389–314 BC, became active in politics about 350. In 348 he was a member of a mission sent to the Peloponnese to stir up feeling against the growing power of King Philip of Macedon; but in 347, when part of a peacemaking embassy to Philip, was won over to sympathy with the king, and became a supporter of the peace policy of the Athenian statesman Eubulus. On a second embassy in 346 to ratify a peace Aeschines’ delaying tactics caused the famous orator Demosthenes and Timarchus to accuse him of treason, a charge that he successfully rebutted in the strong extant speech Against Timarchus. In 344–343, when Demosthenes accused him again in a speech, Aeschines replied in the fine extant speech having the same title On the False Embassy and was again acquitted. In 336, when Ctesiphon proposed that Demosthenes should be awarded a crown of gold for state service, Aeschines accused him of proposing something that would violate existing laws. At the trial Aeschines’ extant speech Against Ctesiphon was answered by Demosthenes in his masterpiece On the Crown. Aeschines, discredited, left Athens and set up a school of rhetoric at Rhodes. He died in Samos.
As examples of Greek oratory the speeches of Aeschines rank next to those of Demosthenes, and are important documents for the study of Athenian diplomacy and inner politics.

Seven against Thebes (467) was the second play of its trilogy of related plays on the evil fate of the Theban House. Polyneices tries to regain Thebes from his brother Eteocles; both are killed. In Suppliant Maidens, the first in a trilogy, the daughters of Danaus arrive with him at Argos, whose King and people save them from the wooing of the sons of their uncle Aegyptus. In Prometheus Bound, first or second play of its trilogy about Prometheus, he is nailed to a crag, by order of Zeus, for stealing fire from heaven for men. Defiant after visitors' sympathy and despite advice, he descends in lightning and thunder to Hell. The Oresteia (458), on the House of Atreus, is the only Greek trilogy surviving complete. In Agamemnon, the King returns from Troy, and is murdered by his wife Clytaemnestra. In Libation-Bearers, Orestes with his sister avenges their father Agamemnon's death by counter-murder. In Eumenides, Orestes, harassed by avenging Furies, is arraigned by them at Athens for matricide. Tried by a court set up by Athena, he is absolved, but the Furies are pacified.

An ancient compendium of ancient philosophy.
Placita (Tenets), generally attributed to an author named Aëtius and dating from the late first or early second century AD, was a compendium setting out in summary fashion the principal doctrines and opinions of philosophers and philosophical schools in response to questions and topics in the domain of natural philosophy. Now lost, Placita can be largely reconstructed from the work of three authors working in the period from the second to the fifth century (Pseudo-Plutarch, Stobaeus, and Theodoret) who quote from it extensively.
Placita is organized into five books: First Principles; Cosmology; Meteorology and the Earth; Psychology; and Physiology. Each chapter contains a list of short opinions or tenets, which are ascribed to an individual philosopher and/or school and usually arranged in sections that stress the variety and contrast of the teachings concerned.
Designed as a multi-purpose resource, Placita long served as a manual of neatly packaged doxographic material on a wide variety of topics, to be used for study, as an aide-mémoire, for displays of erudition, for persuasion in rhetorical or apologetic contexts, and for personal enlightenment, and it remains a valuable source for our knowledge of Presocratic and Hellenistic philosophy.
This edition of Aëtius’ Placita offers a fresh translation, ample annotation, and a text fully informed by the latest scholarship.
Through close readings of the painted images in a major sixteenth-century illustrated manuscript, this book demonstrates the critical role that images played in ethnic identity formation and politics in colonial Mexico.
The Relación de Michoacán (1539–1541) is one of the earliest surviving illustrated manuscripts from colonial Mexico. Commissioned by the Spanish viceroy Antonio de Mendoza, the Relación was produced by a Franciscan friar together with indigenous noble informants and anonymous native artists who created its forty-four illustrations. To this day, the Relación remains the primary source for studying the pre-Columbian practices and history of the people known as Tarascans or P’urhépecha. However, much remains to be said about how the Relación’s colonial setting shaped its final form.
By looking at the Relación in its colonial context, this study reveals how it presented the indigenous collaborators a unique opportunity to shape European perceptions of them while settling conflicting agendas, outshining competing ethnic groups, and carving a place for themselves in the new colonial society. Through archival research and careful visual analysis, Angélica Afanador-Pujol provides a new and fascinating account that situates the manuscript’s images within the colonial conflicts that engulfed the indigenous collaborators. These conflicts ranged from disputes over political posts among indigenous factions to labor and land disputes against Spanish newcomers. Afanador-Pujol explores how these tensions are physically expressed in the manuscript’s production and in its many contradictions between text and images, as well as in numerous emendations to the images. By studying representations of justice, landscape, conquest narratives, and genealogy within the Relación, Afanador-Pujol clearly demonstrates the visual construction of identity, its malleability, and its political possibilities.

The untold story of how Russian espionage in imperial China shaped the emergence of the Russian Empire as a global power.
From the seventeenth to the nineteenth century, the Russian Empire made concerted efforts to collect information about China. It bribed Chinese porcelain-makers to give up trade secrets, sent Buddhist monks to Mongolia on intelligence-gathering missions, and trained students at its Orthodox mission in Beijing to spy on their hosts. From diplomatic offices to guard posts on the Chinese frontier, Russians were producing knowledge everywhere, not only at elite institutions like the Academy of Sciences in St. Petersburg. But that information was secret, not destined for wide circulation.
Gregory Afinogenov distinguishes between the kinds of knowledge Russia sought over the years and argues that they changed with the shifting aims of the state and its perceived place in the world. In the seventeenth century, Russian bureaucrats were focused on China and the forbidding Siberian frontier. They relied more on spies, including Jesuit scholars stationed in China. In the early nineteenth century, the geopolitical challenge shifted to Europe: rivalry with Britain drove the Russians to stake their prestige on public-facing intellectual work, and knowledge of the East was embedded in the academy. None of these institutional configurations was especially effective in delivering strategic or commercial advantages. But various knowledge regimes did have their consequences. Knowledge filtered through Russian espionage and publication found its way to Europe, informing the encounter between China and Western empires.
Based on extensive archival research in Russia and beyond, Spies and Scholars breaks down long-accepted assumptions about the connection between knowledge regimes and imperial power and excavates an intellectual legacy largely neglected by historians.

A collective engages and mirrors the critical need for energy justice and transformation
Solarities considers the possibilities of organizing societies and economies around solar energy, and the challenges of a just and equitable transition away from fossil fuels. Far from presenting solarity as a utopian solution to the climate crisis, it critically examines the ambiguous potentials of solarities: plural, situated, and often contradictory.
Here, a diverse collective of activists, scholars, and practitioners critically engage a wide range of relationships and orientations to the sun. They consider the material and infrastructural dimensions of solar power, the decolonial and feminist promises of decentralized energy, solarian relations with more-than-human kin, and the problem of oppressive and weaponized solarities.
