“Diversity” has become a mantra in corporate boardrooms, higher education, and government hiring and contracting. In Identifying Talent, Institutionalizing Diversity, Jiannbin Lee Shiao explains the leading role that large philanthropies have played in establishing diversity as a goal throughout American society in the post–civil rights era. By creating and institutionalizing diversity policies, these private organizations have quietly transformed the practice of affirmative action. Shiao describes how, from the 1960s through the 1990s, philanthropies responded to immigration, the recognition of nonblack minority groups, and the conservative backlash against affirmative action. He shows that these pressures not only shifted discourse and practice within philanthropy away from a binary black-white conception of race but also dovetailed with a change in its mission from supporting “good causes” to “identifying talent.”

Based on three years of research on the racial and ethnic priorities of the San Francisco Foundation and the Cleveland Foundation, Shiao demonstrates the geographically uneven impact of the national transition to diversification. The demographics of the regions served by the foundations in San Francisco and Cleveland are quite different, and paradoxically, the foundation in Cleveland—which serves an area with substantially fewer immigrants—has had greater institutional opportunities for implementing diversity policies. Shiao connects these regional histories with the national philanthropic field by underscoring the prominent role of the Ford Foundation, the third largest private foundation in the country, in shaping diversity policies. Identifying Talent, Institutionalizing Diversity reveals philanthropic diversity policy as a lens through which to focus on U.S. race relations and the role of the private sector in racial politics.

Though privately controlled, foundations perform essential roles that serve society at large. They spearhead some of the world's largest and most innovative initiatives in science, health, education, and the arts, fulfilling important needs that could not be addressed adequately in the marketplace or the public sector. Still, many people have little understanding of what foundations do and how they continue to earn public endorsement. The Legitimacy of Philanthropic Foundations provides a thorough examination of why foundations exist and the varied purposes they serve in contemporary democratic societies. The Legitimacy of Philanthropic Foundations looks at foundations in the United States and Europe to examine their relationship to the state, the market, and civil society. Peter Frumkin argues that unlike elected officials, who must often shy away from topics that could spark political opposition, and corporate officers, who must meet bottom-line priorities, foundations can independently tackle sensitive issues of public importance. Kenneth Prewitt argues that foundations embody elements of classical liberalism, such as individual autonomy and limited government interference in private matters and achieve legitimacy by putting private wealth to work for the public good. Others argue that foundations achieve legitimacy by redistributing wealth from the pockets of rich philanthropists to the poor. But Julian Wolpert finds that foundations do not redistribute money directly to the poor as much as many people believe. Instead, many foundations focus their efforts on education, health, and scientific research, making investments that benefit society in the long-term, and focusing on farsighted issues that a myopic electorate would not have patience to permit its government to address. Originating from private fortunes but working for the public good, independently managed but subject to legal prescriptions, philanthropic foundations occupy a unique space somewhere between the public and private sectors. The Legitimacy of Philanthropic Foundations places foundations in a broad social and historical context, improving our understanding of one of society's most influential—and least understood—organizational forms.

Although numbering fewer than 60,000 in a city of more than 12 million people, Mumbai’s Parsi community is one of the largest private landowners in the city due to its network of public charitable trusts. In Trust Matters Leilah Vevaina explores the dynamics and consequences of this conjunction of religion and capital as well as the activities of giving, disputing, living, and dying it enables. As she shows, communal trusts are the legal infrastructure behind formal religious giving and ritual in urban India that influence communal life. Vevaina proposes the trusts as a horoscope of the city—a constellation of housing, temples, and other spaces providing possible futures. She explores the charitable trust as a technology of time, originating in the nineteenth century, one that structures intergenerational obligations for Mumbai’s Parsis, connecting past and present, the worldly and the sacred. By approaching Mumbai through the legal mechanism of the trust and the people who live within its bounds as well as those who challenge or support it, Vevaina offers a new pathway into exploring property, religion, and kinship in the urban global South.

Cy-près doctrine, which allows the purpose of a failing or impractical charitable gift to be changed, has been understood since the eighteenth century as a medieval canon law principle, derived from Roman law, to rescue souls by making good their last charitable intentions. The Uses of the Dead offers an alternate origin story for this judicial power, grounded in modern, secular concerns.

Posthumous gifts, which required no sacrifice during life, were in fact broadly understood by canon lawyers and medieval donors themselves to have at best a very limited relationship to salvation. As a consequence, for much of the Middle Ages the preferred method for resolving impossible or impractical gifts was to try to reach a consensus among all of the interested parties to the gift, including the donor's heirs and the recipients, with the mediation of the local bishop.

When cy-près emerged in the seventeenth century, it cut a charitable gift o from return to the donor's estate in the event of failure. It also gave the interested parties to the gift (heirs, beneficiaries, or trustees) little authority over resolutions to problematic gifts, which were now considered primarily in relationship to the donor's intent—even as the intent was ultimately honored only in its breach. The Uses of the Dead shows how cy-près developed out of controversies over church property, particularly monastic property, and whether it might be legally turned over to fund education, poor relief, or national defense.

Renaissance humanists hoped to make better, more prudent uses of property; the Reformation sought to correct superstitious abuses of property and ultimately tended to prevent donors' heirs from recovering secularized ecclesiastical gifts; and the early modern state attempted to centralize poor relief and charitable efforts under a more rational, centralized supervision. These three factors combined to replace an older equitable ideal with a new equitable rule—one whose use has rapidly expanded in the modern era to allow assorted approximations and judicial redistributions of property.
