Signed on November 24, 1922, the Colorado River Compact is the cornerstone of a proverbial pyramid—an elaborate body of laws colloquially called the “Law of the River” that governs how human beings use water from the river system dubbed the “American Nile.”

No fewer than forty million people have come to rely on the Colorado River system in modern times—a river system immersed in an unprecedented, unrelenting megadrought for more than two decades. Attempting to navigate this “new normal,” policymakers are in the midst of negotiating new management rules for the river system, a process coinciding with the compact’s centennial that must be completed by 2026.

Animated by this remarkable confluence of events, Cornerstone at the Confluence leverages the centennial year to reflect on the compact and broader “Law of the River” to envision the future. It is a volume inviting dialogue about how the Colorado River system’s flows should be apportioned given climate change, what should be done about environmental issues such as ecosystem restoration and biodiversity protection, and how long-standing issues of water justice facing Native American communities should be addressed.

In one form or another, all these topics touch on the concept of “equity” embedded within the compact—a concept that tees up what is perhaps the foundational question confronted by Cornerstone at the Confluence: Who should have a seat at the table of Colorado River governance?

This comprehensive new book replaces and substantially expands upon the landmark Fishes of Arizona, which has been the authoritative source since it was first published in 1973. Inland Fishes of the Greater Southwest is a one-volume guide to native and non-native fishes of the lower Colorado River basin, downstream from the Grand Canyon, and of the northern tributaries of the Sea of Cortez in the United States and Mexico. In all, there are in-depth accounts of more than 165 species representing 30 families. The book is not limited to the fish. It provides insights into their aquatic world with information on topography, drainage relations, climate, geology, vegetational history, aquatic habitats, human-made water systems, and conservation. A section of the book is devoted to fish identification, with keys to native and non-native families as well as family keys to species. The book is illustrated with more than 120 black-and-white illustrations, 47 full-color plates of native fishes, and nearly 40 maps and figures.

Many native fish species are unique to the Southwest. They possess interesting and unusual adaptations to the challenges of the region, able to survive silt-laden floods as well as extreme water temperatures and highly fluctuating water flows ranging from very low levels to flash floods. However, in spite of being well-adapted, many of the fish described here are threatened or endangered, often due to the acts of humans who have altered the natural habitat. For that reason, Inland Fishes of the Greater Southwest presents a vast amount of information about the ecological relationships between the fishes it describes and their environments, paying particular attention to the ways in which human interactions have modified aquatic ecosystems—and to how humans might work to ensure the survival of rapidly disappearing native species.

Law and the Living Colorado River asserts that the so-called Law of the River—the vast assemblage of interstate compacts, international treaties, federal and state statutes, regulations, contracts, and other legal documents governing use and management of the Colorado River—ignores the needs of the river as a nested system of aquatic and aquatic-dependent ecosystems. Although society now recognizes and appreciates the natural values of the Colorado River, the Law of the River remains fixed in service of human economies like irrigation and hydropower. Robert W. Adler contends that the law must respond to changing values that prioritize natural systems alongside human ones. He proposes acknowledging the legal rights of the river itself, following the recent movement to recognize rights of nature in other ecosystems around the world. Recognizing that U.S. law has significant barriers to that proposal, however, Adler borrows from aspects of international water law to propose as a shorter-term strategy amendments to the Colorado River Compact that would enhance protection of the river’s environmental needs and values.

Adler delivered this lecture on March 17, 2022, at the 27th annual symposium of the Wallace Stegner Center for Land, Resources and the Environment, jointly sponsored by the Wallace Stegner Center and the Water & Tribes Initiative | Colorado River Basin.

The passage of the 1902 Reclamation Act created a mandate for the federal government to build dams on the Colorado River and its powerful tributaries. By 1920 the US Geological Survey had surveyed the river’s main courses, but still needed accurate charts of the last stretches of deep canyons and white-water rapids, accessible only by boat.Rough-Water Man is the first detailed account of these mapping expeditions by the USGS—the San Juan Canyon in 1921, the upper Green River in 1922, and the Grand Canyon in 1923. Illustrated throughout with period photographs, it is also the personal story of twenty-four-year-old Henry Elwyn Blake Jr., the only boatman to crew on each of the three trips, evolving from novice waterman to expert rapids runner. Drawing on Blake’s diaries, as well as the writings of other USGS surveyors, Rough-Water Man conveys the danger and hardships of navigating these waters with heavy wooden boats and oars. Even today, in rubber pontoons, traversing these canyons is an awesome and exhilarating experience. When Blake and his companions surveyed it, the Colorado ran free and wild from Wyoming to the Sea of Cortez. Westwood gives us mile-by-mile and day-by-day accounts of running these rapids before their canyons were flooded and waters tamed, before the rivers had ever been charted.

Science Be Dammed is an alarming reminder of the high stakes in the management—and perils in the mismanagement—of water in the western United States.  It seems deceptively simple: even when clear evidence was available that the Colorado River could not sustain ambitious dreaming and planning by decision-makers throughout the twentieth century, river planners and political operatives irresponsibly made the least sustainable and most dangerous long-term decisions.

Arguing that the science of the early twentieth century can shed new light on the mistakes at the heart of the over-allocation of the Colorado River, authors Eric Kuhn and John Fleck delve into rarely reported early studies, showing that scientists warned as early as the 1920s that there was not enough water for the farms and cities boosters wanted to build. Contrary to a common myth that the authors of the Colorado River Compact did the best they could with limited information, Kuhn and Fleck show that development boosters selectively chose the information needed to support their dreams, ignoring inconvenient science that suggested a more cautious approach.

Today water managers are struggling to come to terms with the mistakes of the past. Focused on both science and policy, Kuhn and Fleck unravel the tangled web that has constructed the current crisis. With key decisions being made now, including negotiations for rules governing how the Colorado River water will be used after 2026, Science Be Dammed offers a clear-eyed path forward by looking back.

Understanding how mistakes were made is crucial to understanding our contemporary problems. Science Be Dammed offers important lessons in the age of climate change about the necessity of seeking out the best science to support the decisions we make.
