Opening a new area in Latin American studies, The Birth of the Penitentiary in Latin America showcases the most recent historical outlooks on prison reform and criminology in the Latin American context. The essays in this collection shed new light on the discourse and practice of prison reform, the interpretive shifts induced by the spread of criminological science, and the links between them and competing discourses about class, race, nation, and gender. The book shows how the seemingly clear redemptive purpose of the penitentiary project was eventually contradicted by conflicting views about imprisonment, the pervasiveness of traditional forms of repression and control, and resistance from the lower classes.

The essays are unified by their attempt to view the penitentiary (as well as the variety of representations conveyed by the different reform movements favoring its adoption) as an interpretive moment, revealing of the ideology, class fractures, and contradictory nature of modernity in Latin America. As such, the book should be of interest not only to scholars concerned with criminal justice history, but also to a wide range of readers interested in modernization, social identities, and the discursive articulation of social conflict. The collection also offers an up-to-date sampling of new historical approaches to the study of criminal justice history, illuminates crucial aspects of the Latin American modernization process, and contrasts the Latin American cases with the better known European and North American experiences with prison reform.

The Thirteenth Amendment to the United States Constitution, passed in 1865, has long been viewed as a definitive break with the nation’s past by abolishing slavery and ushering in an inexorable march toward black freedom. Slaves of the State presents a stunning counterhistory to this linear narrative of racial, social, and legal progress in America.

Dennis Childs argues that the incarceration of black people and other historically repressed groups in chain gangs, peon camps, prison plantations, and penitentiaries represents a ghostly perpetuation of chattel slavery. He exposes how the Thirteenth Amendment’s exception clause—allowing for enslavement as “punishment for a crime”—has inaugurated forms of racial capitalist misogynist incarceration that serve as haunting returns of conditions Africans endured in the barracoons and slave ship holds of the Middle Passage, on plantations, and in chattel slavery.

Childs seeks out the historically muted voices of those entombed within terrorizing spaces such as the chain gang rolling cage and the modern solitary confinement cell, engaging the writings of Toni Morrison and Chester Himes as well as a broad range of archival materials, including landmark court cases, prison songs, and testimonies, reaching back to the birth of modern slave plantations such as Louisiana’s “Angola” penitentiary.

Slaves of the State paves the way for a new understanding of chattel slavery as a continuing social reality of U.S. empire—one resting at the very foundation of today’s prison industrial complex that now holds more than 2.3 million people within the country’s jails, prisons, and immigrant detention centers.

Stateville penitentiary in Illinois has housed some of Chicago's most infamous criminals and was proclaimed to be "the world's toughest prison" by Joseph Ragen, Stateville's powerful warden from 1936 to 1961. It shares with Attica, San Quentin, and Jackson the notoriety of being one of the maximum security prisons that has shaped the public's conception of imprisonment. In Stateville James B. Jacobs, a sociologist and legal scholar, presents the first historical examination of a total prison organization—administrators, guards, prisoners, and special interest groups.

Jacobs applies Edward Shils's interpretation of the dynamics of mass society in order to explain the dramatic events of the past quarter century that have permanently altered Stateville's structure. With the extension of civil rights to previously marginal groups such as racial minorities, the poor, and, ultimately, the incarcerated, prisons have moved from society's periphery toward its center. Accordingly Stateville's control mechanisms became less authoritarian and more legalistic and bureaucratic. As prisoners' rights increased, the preogatives of the staff were sharply curtailed. By the early 1970s the administration proved incapable of dealing with politicized gangs, proliferating interest groups, unionized guards, and interventionist courts.

In addition to extensive archival research, Jacobs spent many months freely interacting with the prisoners, guards, and administrators at Stateville. His lucid presentation of Stateville's troubled history will provide fascinating reading for a wide audience of concerned readers.
