A Measure of Malpractice tells the story and presents the results of the Harvard Medical Practice Study, the largest and most comprehensive investigation ever undertaken of the performance of the medical malpractice system. The Harvard study was commissioned by the government of New York in 1986, in the midst of a malpractice crisis that had driven insurance premiums for surgeons and obstetricians in New York City to nearly $200,000 a year.
The Harvard-based team of doctors, lawyers, economists, and statisticians set out to investigate what was actually happening to patients in hospitals and to doctors in courtrooms, launching a far more informed debate about the future of medical liability in the 1990s. Careful analysis of the medical records of 30,000 patients hospitalized in 1984 showed that approximately one in twenty-five patients suffered a disabling medical injury, one quarter of these as a result of the negligence of a doctor or other provider. After assembling all the malpractice claims filed in New York State since 1975, the authors found that just one in eight patients who had been victims of negligence actually filed a malpractice claim, and more than two-thirds of these claims were filed by the wrong patients.
The study team then interviewed injured patients in the sample to discover the actual financial loss they had experienced: the key finding was that for roughly the same dollar amount now being spent on a tort system that compensates only a handful of victims, it would be possible to fund comprehensive disability insurance for all patients significantly disabled by a medical accident. The authors, who came to the project from very different perspectives about the present malpractice system, are now in agreement about the value of a new model of medical liability. Rather than merely tinker with the current system which fixes primary legal responsibility on individual doctors who can be proved medically negligent, legislatures should encourage health care organizations to take responsibility for the financial losses of all patients injured in their care.
While Louis XVIII, Charles X, and Louis Philippe ruled in France, a vast majority of politically unenfranchised Frenchmen were developing their own subculture. Only recently literate, they fashioned their own literature. It consisted of two important genres: the popular novel and the melodrama. As we trace these genres from the turn of the nineteenth century until that moment of February 25, 1848, when the Second Republic was declared, we are also led to a detailed scrutiny of the injustices which the immense majority of the French suffered and of the political causes they espoused. The succession of heroes and villains in their literature mirrored accurately the fears and hopes they felt.
The Other Latinos addresses an important topic: the presence in the United States of Latin American and Caribbean immigrants from countries other than Mexico, Cuba, and Puerto Rico. Focusing on the Andes, Central America, and Brazil, the book brings together essays by a number of accomplished scholars.

Marrow follows with general observations that bring out the many facets of race, ethnicity, and identity. Claret Vargas analyzes the poetry of Eduardo Mitre, followed by Edmundo Paz Soldán's reflections on Bolivians' "obsessive signs of identity." Nestor Rodriguez discusses the tensions between Mexican and Central American immigrants, while Arturo Arias's piece on Central Americans moves brilliantly between the literary (and the cinematic), the historical, and the material. Four Brazilian chapters complete the work.
The editors hope that this introductory work will inspire others to continue these initial inquiries so as to construct a more complete understanding of the realities of Latin American migration into the United States.
The company is under-performing, its share price is trailing, and the CEO gets...a multi-million-dollar raise. This story is familiar, for good reason: as this book clearly demonstrates, structural flaws in corporate governance have produced widespread distortions in executive pay. Pay without Performance presents a disconcerting portrait of managers' influence over their own pay--and of a governance system that must fundamentally change if firms are to be managed in the interest of shareholders.
Lucian Bebchuk and Jesse Fried demonstrate that corporate boards have persistently failed to negotiate at arm's length with the executives they are meant to oversee. They give a richly detailed account of how pay practices--from option plans to retirement benefits--have decoupled compensation from performance and have camouflaged both the amount and performance-insensitivity of pay. Executives' unwonted influence over their compensation has hurt shareholders by increasing pay levels and, even more importantly, by leading to practices that dilute and distort managers' incentives.

Lucian Pye, one of the most knowledgeable observers of China, unfolds in this book a deep psychological analysis of Chinese political culture. The dynamics of the Cultural Revolution, the behavior of the Red Guards, and the compulsions of Mao Tse-tung are among the important symptoms examined. But Pye goes behind large events, exploring the more enduring aspects of Chinese culture and the stable elements of the national psychology as they have been manifested in traditional, Republican, and Communist periods.
