The story of one of the longest-lived and most successful nomadic enclaves in North America provides a rare glimpse into the material expressions of Apache self-determination and survival. For nearly 200 years the Jicarilla Apache of New Mexico thrived in the interstices of Pueblo and Spanish settlements following their expulsion from the Plains. Critical to their success was their ability to extend key aspects of Plains-Pueblo exchange to Indian and mixed-blood communities on the fringes of colonial rule. More than other nomadic tribes, the Jicarilla played an enormous role in holding together the social fabric of New Mexican villages after the fall of the Spanish Empire.
This comprehensive study by Sunday Eiselt begins with the great Athapaskan migration out of Canada during prehis-toric times and ends with the forced settlement of the Jicarilla on the Dulce reservation in the 1880s. Eiselt combines archaeological and ethnohistorical data in an examination of Jicarilla strategies for self-preservation. She reveals the ideological and political imperatives of “belonging” that shaped their interactions with local communities and the state and that enabled them to avoid reservation life well into the 1880s. Throughout their long history, Jicarilla identity remained intact, distinctive, and discernable even as life on the reservation disrupted the intimate connections that once existed with their Hispanic and Pueblo neighbors.
Much of our law is based on authoritative texts, such as constitutions and statutes. The common law, in contrast, is that part of the law that is established by the courts. Common law rules predominate in some areas of law, such as torts and contracts, and are extremely important in other areas, such as corporations. Nevertheless, it has been far from clear what principles courts use—or should use—in establishing common law rules. In this lucid yet subtly argued book, Melvin Eisenberg develops the principles that govern this process.
The rules established in every common law case, he shows, are a product of the interplay between the rules announced in past precedents, on the one hand, and moral norms, policies, and experience, on the other. However, a court establishing a common law rule is not free, as a legislator would be, to employ those norms and policies it thinks best. Rather, it can properly employ only those that have a requisite degree of social support. More specifically, the common law should seek to satisfy three standards. First, it should correspond to the body of rules that would be arrived at by giving appropriate weight to all moral norms, policies, and experiential propositions that have the requisite support, and by making the best choices where norms, policies, and experience conflict. Second, all the rules that make up the body of the law should be consistent with one another. Third, the rules adopted in past precedents should be applied consistently over time. Often, these three standards point in the same direction. The central problems of legal reasoning arise when they do not. These problems are resolved by the principles of common law adjudication. With the general principles of common law adjudication as a background, the author then examines and explains the specific modes of common law reasoning, such as reasoning from precedent, reasoning by analogy, drawing distinctions, and overruling. Throughout the book, the analysis is fully illustrated by leading cases.

Theodore Roosevelt was a man of wide interests, strong opinions, and intense ambition for both himself and his country. When he met Leonard Wood in 1897, he recognized a kindred spirit. Moreover, the two men shared a zeal for making the United States an imperial power that would challenge Great Britain as world leader. For the remainder of their lives, their careers would intertwine in ways that shaped the American nation.
When the Spanish American War came, both men seized the opportunity to promote the goals of American empire. Roosevelt resigned as assistant secretary of the navy in William McKinley’s administration to serve as a lieutenant colonel of the Rough Riders, a newly organized volunteer cavalry. Wood, then a captain in the medical corps and physician to McKinley, was promoted to colonel and given charge of the unit.
Roosevelt later took over command of the Rough Riders. In the Battle of San Juan Hill, he led it in a charge up Kettle Hill that would end in victory for the American troops and make their daring commander a household name, a war hero, and, eventually, president of the United States.
At the Treaty of Paris in 1898, Spain ceded Cuba, Puerto Rico, Guam, and the Philippines to the United States. The next year, Wood became military governor of Cuba. He remained in the post until 1902. By that time Roosevelt was president. One of the major accomplishments of his administration was reorganization of the War Department, which the war with Spain had proved disastrously outdated. In 1909, when William Howard Taft needed a strong army chief of staff to enforce the new rules, he appointed Leonard Wood.
Both Wood and Roosevelt were strong proponents of preparedness, and when war broke out in Europe in August 1914, Wood, retired as chief of staff and backed by Roosevelt, established the “Plattsburg camps,” a system of basic training camps. When America entered the Great War, the two men’s foresight was justified, but their earlier push for mobilization had angered Woodrow Wilson, and both were denied the command positions they sought in Europe.
Roosevelt died in 1919 while preparing for another presidential campaign. Wood made a run in his place but was never taken seriously as a candidate. He retired from the army and spent the last seven years of his life as civilian governor of the Philippines.
It was a quiet end for two men who had been giants of their time. While their modernization of the army is widely admired, they were not without their critics. Roosevelt and Wood saw themselves as bold leaders but were regarded by some as ruthless strivers. This is the only English biography of Buonarroti and the only book in any language to treat him as “the first professional revolutionist.” It provides a detailed historiographical analysis of recent Italian Buonarrotian research, bearing on a wide variety of different special aspects of modern European history. It throws light on the conspiratorial underground of the early nineteenth century, on the relationship between the French Revolution and nineteenth century radical movements, on the historiography of the French Revolution, and on the development of the ideology of the totalitarian Left. Perhaps the main contribution made by this study is to provide precise factual data on aspects of pre-Marxian radicalism that have been heretofore treated in a vague, overgeneralized fashion.
Buonarroti is regarded as the focal point for a preliminary investigation into the origins of an important but neglected profession which developed during the early nineteenth century. In the introduction, a distinction is drawn between the “amateur” revolutionist—the doctor, lawyer, or merchant who played a prominent role in various particular revolutions—and the frequently unemployed professional who attempted to create a situation that would make possible the practice of his craft and who had a vested interest in “revolution” in general but did not necessarily play a part in any particular revolution.
In the following chapters, the entire course of Buonarroti’s long career is surveyed chronologically, in an effort to account for the emergence of this new type of man. He is viewed as a youthful disciple of Rousseau, studying law at the University of Pisa; as a follower of Robespierre who served as a Jacobin agent in Corsica and Oneglia and was granted French citizenship by the National Convention; as a colleague of Babeuf and later author of the classic account of the Conspiracy of the Equals; as a political prisoner during the Empire who was involved in anti-Bonapartist plots; as the arch-conspirator whose agents infiltrated the revolutionary secret societies of Metternich’s Europe; as Mazzini’s rival in the Risorgimento; and finally, as the patriarch venerated by radical Frenchmen, who indoctrinated a new generation of young Parisians while directing political propaganda and agitation against the Orleanist Regime and reshaping the mythology of the French Revolution. At each of these stages of Buonarroti’s career, his ideological orientation is analyzed, his present position in historiography examined, and his actual historical contribution suggested.
The concluding chapter offers a reappraisal of the historical significance of Buonarroti’s life and work. As a secular fundamentalist who took the words of the eighteenth-century philosophers literally and as a devout Jacobin who had seen in the First Republic his “heavenly city” materialize on earth, Buonarroti was incapable of coming to terms with the post-Thermidorian world. He achieved a new career by remaining frozen in the heroic pose of 1793 while outliving his times by over four decades. Although he dedicated his life to preparing for the great day that would restore the First Republic and thus shake the world, he failed to accomplish the mission he had set himself. However, he succeeded as a prototype. Others were eventually inspired by his example to adopt a similar vocation, with fateful consequence to all of Western civilization.
The study concludes with a bibliographical essay containing a brief note on the probable role of the Italian Communist Party in stimulating Buonarrotian research in Italy and extensive critical discussion of selected scholarly literature on the various phases of Buonarroti’s career.
Originally published in 1961, The Ideologies of Taxation is a classic of taxation—a long-unavailable volume that remains uniquely applicable today. Louis Eisenstein starts from the idea that the tax system in a democracy is shaped by competing factions, each seeking to minimize its burden. Because few people are convinced by appeals to self-interest, factions must give reasons, which are skillfully elaborated into systems of belief or ideologies.
Eisenstein’s aim is to examine (and debunk) three major ideologies used to justify various reforms of the tax system. The ideology of ability holds that taxes should be apportioned based on ability to pay and that this is properly measured by income or wealth. The ideology of deterrents is concerned with high taxes on private enterprise—low and flat taxes are desired lest the wealthy reduce their work efforts and savings. The ideology of equity is focused on equal treatment of similarly situated individuals. Eisenstein shows, with sharp wit and an instinct for the jugular, how each of these ideologies is plagued with contradictions, incompleteness, and, in some cases, self-serving claims.
Most of us regard the Constitution as the foundation of American democracy. How, then, are we to understand the restrictions that it imposes on legislatures and voters? Why, for example, does the Constitution allow unelected judges to exercise so much power? And why is this centuries-old document so difficult to amend? In short, how can we call ourselves a democracy when we are bound by an entrenched, and sometimes counter-majoritarian, constitution?
In Constitutional Self-Government, Christopher Eisgruber focuses directly on the Constitution's seemingly undemocratic features. Whereas other scholars have tried to reconcile these features with majority rule, or simply acknowledged them as necessary limits on democracy, Eisgruber argues that constitutionalism is best regarded not as a constraint upon self-government, but as a crucial ingredient in a complex, non-majoritarian form of democracy. Religion has become a charged token in a politics of division. How did this body of information become so valuable? Questions such as these have preoccupied philosophers and theologians for ages, but there was a time, during the seventeenth and eighteenth centuries, when scientists and mathematicians felt they could provide the answer.
This book is their story. Ivar Ekeland here takes the reader on a journey through scientific attempts to envision the best of all possible worlds. He begins with the French physicist Maupertuis, whose least action principle asserted that everything in nature occurs in the way that requires the least possible action. This idea, Ekeland shows, was a pivotal breakthrough in mathematics, because it was the first expression of the concept of optimization, or the creation of systems that are the most efficient or functional. Although the least action principle was later elaborated on and overshadowed by the theories of Leonhard Euler and Gottfried Leibniz, the concept of optimization that emerged from it is an important one that touches virtually every scientific discipline today.

The eleventh-century monk Ekkehard IV’s Fortune and Misfortune at Saint Gall, part of the chronicles of the famous Swiss abbey, is a treasure trove of medieval monastic life. Saint Gall’s records span its humble beginnings in the early seventh century to the late Middle Ages, with Ekkehard’s contribution covering the 880s to 972, near the end of the monastery’s two-century-long golden age. Its unforgettable tales, sometimes at odds with the historical record, contain sharp flashes of Ekkehard’s signature humor—when, for instance, a spying abbot from a neighboring monastery is caught hiding in the latrine. Ekkehard also shows how the abbey’s role as a spiritual haven could be compromised by worldly ties, including close associations with the powerful Carolingian and Ottonian courts. He bears witness to the struggles of the tenth-century church reform movement, when Emperor Otto I dispatched investigators to uncover Saint Gall’s deviations from the Rule of Saint Benedict.

The Chadian writer Nimrod—philosopher, poet, novelist, and essayist—is one of the most dynamic and vital voices in contemporary African literature and thought. Yet little of Nimrod’s writing has been translated into English until now. Introductory material by Frieda Ekotto provides context for Nimrod’s work and demonstrates the urgency of making it available beyond Francophone Africa to a broader global audience.
At the heart of this volume are Nimrod’s essays on Léopold Sédar Senghor, a key figure in the literary and aesthetic Négritude movement of the 1930s and president of Senegal from 1945 through 1980. Widely dismissed in recent decades as problematically essentialist, Senghorian Negritude articulated notions of “blackness” as a way of transcending deep divisions across a Black Diaspora under French colonial rule. Nimrod offers a nuanced reading of Senghor, drawing out the full complexities of Senghor’s philosophy and reevaluating how race and colonialism function in a French-speaking space.
Also included in this volume are Nimrod’s essays on literature from the 2008 collection, The New French Matter (La nouvelle chose française). Representing his prose fiction is his 2010 work, Rivers’ Gold (L’or des rivières). Also featured are some of Nimrod’s best-loved poems, in both English translation and the original French.

In Modris Eksteins’s hands, the interlocking stories of Vincent van Gogh and art dealer Otto Wacker reveal the origins of the fundamental uncertainty that is the hallmark of the modern era. Through the lens of Wacker’s sensational 1932 trial in Berlin for selling fake Van Goghs, Eksteins offers a unique narrative of Weimar Germany, the rise of Hitler, and the replacement of nineteenth-century certitude with twentieth-century doubt.

Fatna El Bouih was first arrested in Casablanca as an 18-year-old student leader with connections to the Marxist movement. When the Abbasids overthrew the Umayyad dynasty in 750 CE, an important element in legitimizing their newly won authority involved defining themselves in the eyes of their Islamic subjects. Nadia Maria El Cheikh shows that ideas about women were central to the process by which the Abbasid caliphate, which ushered in Islam’s Golden Age, achieved self-definition.
In most medieval Islamic cultures, Arab Islam stood in opposition to jahl, or the state of impurity and corruption that existed prior to Islam’s founding. Over time, the concept of jahl evolved into a more general term describing a condition of ignorance and barbarism—as well as a condition specifically associated in Abbasid discourse with women. Concepts of womanhood and gender became a major organizing principle for articulating Muslim identity. Groups whose beliefs and behaviors were perceived by the Abbasids as a threat—not only the jahilis who lived before the prophet Muhammad but peoples living beyond the borders of their empire, such as the Byzantines, and heretics who defied the strictures of their rule, such as the Qaramita—were represented in Abbasid texts through gendered metaphors and concepts of sexual difference. These in turn influenced how women were viewed, and thus contributed to the historical construction of Muslim women’s identity.
Through its investigation of how gender and sexuality were used to articulate cultural differences and formulate identities in Abbasid systems of power and thought, Women, Islam, and Abbasid Identity demonstrates the importance of women to the writing of early Islamic history.

The breakdown was less a civil war in the conventional sense than a series of little wars with outside interference.
Set in a small village in the Egyptian Delta, El-Bisatie's finely tuned novella illustrates the social and sexual tensions in a community in which nothing is secret and where people's pasts haunt their present.
When Mussad catches the butcher's son Amer with his wife, the whole village knows and waits with bated breath for Mussad to exact his revenge. But something goes wrong. Mussad's ill-planned schemes are choked by an opaque veil of history—his wife's sexual past, the war-torn lives of their families, and the personal allegiances of his friends and enemies. The village women relive private desires and inner fears as the men take sides in the struggle, either to protect Amer from Mussad's wrath or to help Mussad track down and confront his nemesis.
In the words of Denys Johnson-Davies, "El-Bisatie is a writer's writer, which is to say a writer who makes no concession to the lazy reader. El-Bisatie stands back from his canvas and sketches his characters and events with a studied detachment. While there is drama in his stories it is never highlighted. The menace lurks almost unseen between the lines."
Attitudes toward homosexuality in the pre-modern Arab-Islamic world are commonly depicted as schizophrenic—visible and tolerated on one hand, prohibited by Islam on the other. Khaled El-Rouayheb argues that this apparent paradox is based on the anachronistic assumption that homosexuality is a timeless, self-evident fact to which a particular culture reacts with some degree of tolerance or intolerance. Drawing on poetry, biographical literature, medicine, dream interpretation, and Islamic texts, he shows that the culture of the period lacked the concept of homosexuality.
European Others offers an interrogation into the position of racialized communities in the European Union, arguing that the tension between a growing nonwhite, non-Christian population and insistent essentialist definitions of Europeanness produces new forms of identity and activism. Moving beyond disciplinary and national limits, Fatima El-Tayeb explores structures of resistance, tracing a Europeanization from below in which migrant and minority communities challenge the ideology of racelessness that places them firmly outside the community of citizens.
Using a notable variety of sources, from drag performances to feminist Muslim activism and Euro hip-hop, El-Tayeb draws on the largely ignored archive of vernacular culture central to resistance by minority youths to the exclusionary nationalism that casts them as threatening outcasts. At the same time, she reveals the continued effect of Europe’s suppressed colonial history on the representation of Muslim minorities as the illiberal Other of progressive Europe.
Presenting a sharp analysis of the challenges facing a united Europe seen by many as a model for twenty-first-century postnational societies, El-Tayeb combines theoretical influences from both sides of the Atlantic to lay bare how Europeans of color are integral to the continent’s past, present, and, inevitably, its future.
