Bad Souls is an ethnographic study of responsibility among psychiatric patients and their caregivers in Thrace, the northeastern borderland of Greece. Elizabeth Anne Davis examines responsibility in this rural region through the lens of national psychiatric reform, a process designed to shift treatment from custodial hospitals to outpatient settings. Challenged to help care for themselves, patients struggled to function in communities that often seemed as much sources of mental pathology as sites of refuge. Davis documents these patients' singular experience of community, and their ambivalent aspirations to health, as they grappled with new forms of autonomy and dependency introduced by psychiatric reform. Planned, funded, and overseen largely by the European Union, this "democratic experiment," one of many reforms adopted by Greece since its accession to the EU in the early 1980s, has led Greek citizens to question the state and its administration of human rights, social welfare, and education. Exploring the therapeutic dynamics of diagnosis, persuasion, healing, and failure in Greek psychiatry, Davis traces the terrains of truth, culture, and freedom that emerge from this questioning of the state at the borders of Europe.

The Beast and the Sovereign, Volume 1 launches the series with Derrida’s exploration of the persistent association of bestiality or animality with sovereignty. In this seminar from 2001–2002, Derrida continues his deconstruction of the traditional determinations of the human. The beast and the sovereign are connected, he contends, because neither animals nor kings are subject to the law—the sovereign stands above it, while the beast falls outside the law from below. He then traces this association through an astonishing array of texts, including La Fontaine’s fable “The Wolf and the Lamb,” Hobbes’s biblical sea monster in Leviathan, D. H. Lawrence’s poem “Snake,” Machiavelli’s Prince with its elaborate comparison of princes and foxes, a historical account of Louis XIV attending an elephant autopsy, and Rousseau’s evocation of werewolves in The Social Contract.

Deleuze, Lacan, and Agamben also come into critical play as Derrida focuses in on questions of force, right, justice, and philosophical interpretations of the limits between man and animal.

As he moves back and forth between the two works, Derrida pursuesthe relations between solitude, insularity, world, violence, boredom and death as they supposedly affect humans and animals in different ways.
 
Hitherto unnoticed or underappreciated aspects of Robinson Crusoe are brought out in strikingly original readings of questions such as Crusoe’s belief in ghosts, his learning to pray, his parrot Poll, and his reinvention of the wheel. Crusoe’s terror of being buried alive or swallowed alive by beasts or cannibals gives rise to a rich and provocative reflection on death, burial, and cremation, in part provoked by a meditation on the death of Derrida’s friend Maurice Blanchot.  Throughout, these readings are juxtaposed with interpretations of Heidegger's concepts of world and finitude to produce a distinctively Derridean account that will continue to surprise his readers.

As Elaine Draper argues in The Company Doctor, company doctors are bound by two conflicting ideals: serving the medical needs of their patients while protecting the company's bottom line. Draper analyzes the advent of the corporate physician both as an independent phenomenon, and as an index of contemporary culture, reaching startling conclusions about the intersection of corporate culture with professional autonomy. Drawing on over 100 interviews with company physicians, scientists, and government and labor officials, as well as historical, legal, and statistical sources and medical trade association data, Draper presents an illuminating overview of the social context and meaning of professional work in corporations. Draper finds that while medical journals, speeches, and ethical codes proclaim the independent professional judgment of corporate physicians, the company doctors she interviewed often expressed anguish over the tightrope they must walk between their patients' health and the corporate oversight they face at every turn. Draper dissects the complex position occupied by company doctors to explore broad themes of doctor-patient trust, employee loyalty, privacy issues, and the future direction of medicine. She addresses such controversial topics as drug screening and the difficult position of company doctors when employees sue companies for health hazards in the workplace. Company doctors are but one example of professionals who have at times ceded their autonomy to corporate management. Physicians provide the prototypical professional case for exploring this phenomenon, due to their traditional independence, extensive training, and high levels of prestige. But Draper expands the scope of the book—tracing parallel developments in the law, science, and technology—to draw insightful conclusions about changing conditions in the professional workplace, as corporate cultures everywhere adapt to the new realities of the global economy. Jarecke and Plant note that while we in the United States worry considerably about the problem of individual assumption of responsibility—whether for personal mistakes, financial setbacks, or pure bad luck—we appear uneasy about the concept and unclear about what it means on a daily basis. Not only are we incapable of accepting personal responsibility; we barely know what it means to do so.

Mistakenly, we turn to the legal system to solve this dilemma. Yet our laws as our legislators write them, as judges interpret them, as lawyers argue them, and as juries apply them send mixed messages about whether and how we should exercise personal responsibility.

Each chapter of Confounded Expectations features one main case to explain one legal theory, with other cases noted as examples of facets of each theory. To demonstrate the law that requires merchants to guarantee the quality of their products, for example, Jarecke and Plant discuss the case of the band mothers whose fund-raising luncheon menu included turkey salad contaminated by salmonella.  Peripheral cases include a horse falsely sold as a gelding, a riding mower that tipped over when used as instructed, makeup that was guaranteed to be safe but caused a rash, and pigs sick with hog cholera.

She shows that they often act on behalf of people they see as neighbors, not friends, as allies, not intimates, and people with whom they have an imagined relationship, not a real one. To repair our fractured civic landscape, she argues, we should draw on the rich language of solidarity that Americans already have.

The recent past has seen striking advances in our understanding of both moral responsibility and distributive justice. S. L. Hurley's ambitious work brings these two areas of lively debate into overdue contact with each other.

Key contemporary discussions of distributive justice have formulated egalitarian approaches in terms of responsibility; in this view, the aim of egalitarianism is to respect differences between positions for which people are responsible while neutralizing differences that are a matter of luck. But this approach, Hurley contends, has ignored the way our understanding of responsibility constrains the roles it can actually play within distributive justice. Her book brings the new articulation of responsibility to bear in explaining these constraints. While responsibility might help specify what to distribute, it cannot tell us how to distribute; thus, Hurley argues, responsibility cannot tell us to distribute in an egalitarian pattern in particular. It can, however, play other important roles in a theory of justice, in relation to incentive-seeking behavior and well-being. Hurley's book proposes a new, bias-neutralizing approach to distributive justice that places responsibility in these less problematic roles.

Approaching punishment and responsibility from a philosophical perspective, Erin Kelly challenges the moralism behind harsh treatment of criminal offenders and calls into question our society’s commitment to mass incarceration.

The Limits of Blame takes issue with a criminal justice system that aligns legal criteria of guilt with moral criteria of blameworthiness. Many incarcerated people do not meet the criteria of blameworthiness, even when they are guilty of crimes. Kelly underscores the problems of exaggerating what criminal guilt indicates, particularly when it is tied to the illusion that we know how long and in what ways criminals should suffer. Our practice of assigning blame has gone beyond a pragmatic need for protection and a moral need to repudiate harmful acts publicly. It represents a desire for retribution that normalizes excessive punishment.

Appreciating the limits of moral blame critically undermines a commonplace rationale for long and brutal punishment practices. Kelly proposes that we abandon our culture of blame and aim at reducing serious crime rather than imposing retribution. Were we to refocus our perspective to fit the relevant moral circumstances and legal criteria, we could endorse a humane, appropriately limited, and more productive approach to criminal justice.

Law relies on a conception of human agency, the idea that humans are capable of making their own choices and are morally responsible for the consequences. But what if that is not the case? Over the past half century, the story of the law has been one of increased acuity concerning the human condition, especially the workings of the brain. The law already considers select cognitive realities in evaluating questions of agency and responsibility, such as age, sanity, and emotional distress. As new neuroscientific research comprehensively calls into question the very idea of free will, how should the law respond to this revised understanding?
           
Peter A. Alces considers where and how the law currently fails to appreciate the neuroscientific revelation that humans may in key ways lack normative free will—and therefore moral responsibility. The most accessible setting in which to consider the potential impact of neuroscience is criminal law, as certain aspects of criminal law already reveal the naiveté of most normative reasoning, such as the inconsistent treatment of people with equally disadvantageous cognitive deficits, whether congenital or acquired. But tort and contract law also assume a flawed conception of human agency and responsibility. Alces reveals the internal contradictions of extant legal doctrine and concludes by considering what would be involved in constructing novel legal regimes based on emerging neuroscientific insights.

In an argument both compelling and provocative, Marion Smiley demonstrates how attributions of blame—far from being based on an objective process of factual discovery—are instead judgments that we ourselves make on the basis of our own political and social points of view. She argues that our conception of responsibility is a singularly modern one that locates the source of blameworthiness in an individual's free will. After exploring the flaws inherent in this conception, she shows how our judgments of blame evolve out of our configuration of social roles, our conception of communal boundaries, and the distribution of power upon which both are based.

The great strength of Smiley's study lies in the way in which it brings together both rigorous philosophical analysis and an appreciation of the dynamics of social and political practice. We speak of rights as though they are objective matters of fact that have a crucial bearing on how we ought to behave. Yet few, if any, rights are universally acknowledged without wide differences of meaning. Instead, they usually represent the particular ideals of the individuals or groups that claim them. Theories of rights have always grappled with this central problem, but none of the literature on the subject has offered a satisfactory solution. Lloyd Weinreb makes the first significant advance toward an understanding of what rights are, how they function in our lives, and why we need them.

Weinreb’s central argument is that rights are tightly connected to responsibility. They are the normative constituents of persons, attributes that we have rightly, as our due. As such, they enable us to overcome the antinomy of moral freedom and natural causal order. Without them, we could not regard human beings as persons, that is, as free and responsible, or autonomous. Since responsibility is a structural feature of our experience and a matter of fact, rights too are matters of fact.

Against a review of the current debates on the subject, Weinreb fully elaborates his original argument on the nature of rights and finds the source of concrete rights in the nomos, or deep conventions, of a community. Applying his theory, he shows how it helps to answer specific questions about animal rights, human rights—including, in the context of abortion and capital punishment, the right to life—and civil rights, including particularly rights of the handicapped, gay rights, and affirmative action in contemporary American society. Along the way, Weinreb shows that Oedipus and Roger Clemens have more in common than either would probably have supposed.

This highly original work will significantly redirect the study of rights. It will be especially valuable to those who practice or study law, philosophy, politics, and public policy.

What leads us to respond politically to the deaths of some citizens and not others? This is one of the critical questions Heather Pool asks in Political Mourning. Born out of her personal experiences with the trauma of 9/11, Pool’s astute book looks at how death becomes political, and how it can mobilize everyday citizens to argue for political change. 

Pool examines four tragedies in American history—the Triangle Shirtwaist Factory Fire, the lynching of Emmett Till, the September 11 attacks, and the Black Lives Matter movement—that offered opportunities to tilt toward justice and democratic inclusion. Some of these opportunities were taken, some were not. However, these watershed moments show, historically, how political identity and political responsibility intersect and how racial identity shapes who is mourned. Political Mourning helps explain why Americans recognize the names of Trayvon Martin and Sandra Bland; activists took those cases public while many similar victims have been ignored by the news media. 

Concluding with an afterword on the coronavirus, Pool emphasizes the importance of collective responsibility for justice and why we ought to respond to tragedy in ways that are more politically inclusive.

Politics cannot function without responsibility, but there have been serious disagreements about how responsibility is to be understood and huge controversies about how it is to be distributed, rewarded, legislated, and enforced. The liberal notions of personal responsibility that have dominated political thinking in the West for more than a century are rooted in the familiar territory of individual will and causal blame, but these theories have been assailed as no longer adequate to explain or address the political demands of a global social structure. Informed by Marx, Foucault, and Butler, Chad Lavin argues for a "postliberal" theory of responsibility, formulating responsibility as a process that is anchored in a persistent ability to respond, not reproach. Lavin works this formulation through discussions of contemporary political issues such as globalization, police brutality, and abortion. 

Rather than assigning individual blame, postliberal responsibility challenges the supposed autonomy of individual subjects by taking structural arguments into account. Lavin concludes that a liberal concept of responsibility gives rise to a moralistic and oppressive approach to social problems, while a postliberal approach highlights a shared responsibility for developing collective solutions to systemic problems. Postliberal responsibility not only suggests more generous and democratic responses to social ills, it also allows us to theorize a greater range of issues that demand political response.

After showing how attempts to vindicate morality have tended to change the subject—falling back on nonmoral values or practical, first-person considerations—Darwall elaborates the interpersonal nature of moral obligations: their inherent link to our responsibilities to one another as members of the moral community.

As Darwall defines it, the concept of moral obligation has an irreducibly second-person aspect; it presupposes our authority to make claims and demands on one another. And so too do many other central notions, including those of rights, the dignity of and respect for persons, and the very concept of person itself. The result is nothing less than a fundamental reorientation of moral theory that enables it at last to account for morality's supreme authority—an account that Darwall carries from the realm of theory to the practical world of second-person attitudes, emotions, and actions.

In 2011, the United Nations Security Council adopted Resolution 1973, authorizing its member states to take measures to protect Libyan civilians from Muammar Gadhafi’s forces. In invoking the “responsibility to protect,” the resolution draws on the principle that sovereign states are responsible and accountable to the international community for the protection of their populations and that the international community can act to protect populations when national authorities fail to do so. The idea that sovereignty includes the responsibility to protect is often seen as a departure from the classic definition, but it actually has deep historical roots.
           
In Sovereignty and the Responsibility to Protect, Luke Glanville argues that this responsibility extends back to the sixteenth and seventeenth centuries, and that states have since been accountable for this responsibility to God, the people, and the international community. Over time, the right to national self-governance came to take priority over the protection of individual liberties, but the noninterventionist understanding of sovereignty was only firmly established in the twentieth century, and it remained for only a few decades before it was challenged by renewed claims that sovereigns are responsible for protection.
           
Glanville traces the relationship between sovereignty and responsibility from the early modern period to the present day, and offers a new history with profound implications for the present.

By probing the psychological dynamics of victims and perpetrators of rape, sexual abuse, and domestic violence, Sharon Lamb seeks to answer some crucial questions: How do victims become victims and sometimes perpetrators? How can we break the psychological circle of perpetrators blaming others and victims blaming themselves? How do victims and perpetrators view their actions and reactions? And how does our social response to them facilitate patterns of excuse?

With clarity and compassion, Lamb examines the theories, excuses, and psychotherapies that strip both victims of their power and perpetrators of their agency--and thus deprive them of the means to human dignity, healing, and reparation. She shows how the current practice of painting victims as pure innocents may actually help perpetrators of abuse to shirk responsibility for their actions; they too can claim to be victims in their own right, passive and will-less in their wrongdoing.

The Trouble with Blame clarifies the social cost (quickly becoming so apparent) of letting perpetrators off too easily, and points out the dangers of over-emphasizing victimization, two problems which eclipse our dire need for accountability and recovery.

Americans now obtain college degrees at a higher rate than at any time in recent decades in the hopes of improving their career prospects. At the same time, the rising costs of an undergraduate education have increased dramatically, forcing students and families to take out often unmanageable levels of student debt. The cumulative amount of student debt reached nearly $1.5 trillion in 2017, and calls for student loan forgiveness have gained momentum. Yet public policy to address college affordability has been mixed. While some policymakers support  more public funding to broaden educational access, others oppose this expansion. Noting that public opinion often shapes public policy, sociologists Natasha Quadlin and Brian Powell examine public opinion on who should shoulder the increasing costs of higher education and why.
 
Who Should Pay? draws on a decade’s worth of public opinion surveys analyzing public attitudes about whether parents, students, or the government should be primarily responsible for funding higher education. Quadlin and Powell find that between 2010 and 2019, public opinion has shifted dramatically in favor of more government funding. In 2010, Americans overwhelming believed that parents and students were responsible for the costs of higher education. Less than a decade later, the percentage of Americans who believed that federal or state/local government should be the primary financial contributor has more than doubled. The authors contend that the rapidity of this change may be due to the effects of the 2008 financial crisis and the growing awareness of the social and economic costs of high levels of student debt. Quadlin and Powell also find increased public endorsement of shared responsibility between individuals and the government in paying for higher education. The authors additionally examine attitudes on the accessibility of college for all, whether higher education at public universities should be free, and whether college is worth the costs. 
 
Quadlin and Powell also explore why Americans hold these beliefs. They identify individualistic and collectivist world views that shape public perspectives on the questions of funding, accessibility, and worthiness of college. Those with more individualistic orientations believed parents and students should pay for college, and that if students want to attend college, then they should work hard and find ways to achieve their goals. Those with collectivist orientations believed in a model of shared responsibility – one in which the government takes a greater level of responsibility for funding education while acknowledging the social and economic barriers to obtaining a college degree for many students. The authors find that these belief systems differ among socio-demographic groups and that bias – sometimes unconscious and sometimes deliberate – regarding race and class affects responses from both individualistic and collectivist-oriented participants. 
 
Public opinion is typically very slow to change. Yet Who Should Pay? provides an illuminating account of just how quickly public opinion has shifted regarding the responsibility of paying for a college education and its implications for future generations of students.

The poet George Oppen comments, “There are situations which cannot honorably [be] met by art, and surely no one need fiddle precisely at the moment that the house next door is burning.” To write poetry under such circumstances, he continues, “would be a treason to one’s neighbor.” Committing himself, then, to more direct and conventional forms of response and responsibility, Oppen leaves poetry behind for twenty-five years. The disasters of the 1930s, for Oppen, put poetry into a fundamental question that could not be resolved or overcome. Yet if crisis is continual, then poetry is always turning away from the neighbor in need, always an irresponsible response in a world persistently falling apart.

Writing Not Writing both confirms this question into which crisis puts poetry and explores alternative modes of “response” and “responsibility” that poetry makes possible. Reading the silences of Oppen, Carl Rakosi, and Bob Kaufman, the renunciation of Laura Riding, and other more contemporary instances of poetic abnegation, Tom Fisher explores silence, refusal, and disavowal as political and ethical modes of response in a time of continuous crisis. Through a turn away from writing, these poets offer strategies of refusal and departure that leave anagrammatical hollows behind, activating the negational capacities of writing and aesthetics to disrupt the empire of sense, speech, and agency.

Fisher’s work is both an engaging and detailed analysis of four individual poets who left poetry behind and a theoretically provocative exploration of the political and ethical possibilities of silence, not-doing, and disavowal. In lucid but nuanced terms, Fisher makes the case that, from at least modernism forward, poetry is marked by refusals of speech and sense in order to open possibilities of response outside conventional forms of responsibility.

Benarde also looks at the ways the media reports science and evidence-based medicine.
