In the weeks following 9/11, the Bush administration launched the Patriot Act, rejected key provisions of the Geneva Convention, and inaugurated a sweeping electronic surveillance program for intelligence purposes—all in the name of protecting national security. But the current administration is hardly unique in pursuing such measures. In Security v. Liberty, Daniel Farber leads a group of prominent historians and legal experts in exploring the varied ways in which threats to national security have affected civil liberties throughout American history. Security v. Liberty focuses on periods of national emergency in the twentieth century—from World War I through the Vietnam War—to explore how past episodes might bear upon today's dilemma. Distinguished historian Alan Brinkley shows that during World War I the government targeted vulnerable groups—including socialists, anarchists, and labor leaders—not because of a real threat to the nation, but because it was politically expedient to scapegoat unpopular groups. Nonetheless, within ten years the Supreme Court had rolled back the most egregious of the World War I restrictions on civil liberties. Legal scholar John Yoo argues for the legitimacy of the Bush administration's War on Terror policies—such as the detainment and trials of suspected al Qaeda members—by citing historical precedent in the Roosevelt administration's prosecution of World War II. Yoo contends that, compared to Roosevelt's sweeping use of executive orders, Bush has exercised relative restraint in curtailing civil liberties. Law professor Geoffrey Stone describes how J. Edgar Hoover used domestic surveillance to harass anti-war protestors and civil rights groups throughout the 1960s and early 1970s. Congress later enacted legislation to prevent a recurrence of the Hoover era excesses, but Stone notes that the Bush administration has argued for the right to circumvent some of these restrictions in its campaign against terrorism. Historian Jan Ellen Lewis looks at early U.S. history to show how an individual's civil liberties often depended on the extent to which he or she fit the definition of "American" as the country's borders expanded. Legal experts Paul Schwartz and Ronald Lee examine the national security implications of rapid advances in information technology, which is increasingly driven by a highly globalized private sector, rather than by the U.S. government. Security v. Liberty shows that civil liberties are a not an immutable right, but the historically shifting result of a continuous struggle that has extended over two centuries. This important new volume provides a penetrating historical and legal analysis of the trade-offs between security and liberty that have shaped our national history—trade-offs that we confront with renewed urgency in a post-9/11 world.

Despite high levels of inequality and wage stagnation over several decades, the United States has done relatively little to address these problems—at least in part due to public opinion, which remains highly influential in determining the size and scope of social welfare programs that provide direct benefits to retirees, unemployed workers or poor families. On the other hand, social tax expenditures—or tax subsidies that help citizens pay for expenses such as health insurance or the cost of college and invest in retirement plans—have been widely and successfully implemented, and they now comprise nearly 40 percent of the spending of the American social welfare state.  In The Other Side of the Coin, political scientists Christopher Ellis and Christopher Faricy examine public opinion towards social tax expenditures—the other side of the American social welfare state—and their potential to expand support for such social investment.
 
Tax expenditures seek to accomplish many of the goals of direct government expenditures, but they distribute money indirectly, through tax refunds or reductions in taxable income, rather than direct payments on goods and services or benefits. They tend to privilege market-based solutions to social problems such as employer-based tax subsidies for purchasing health insurance versus government-provided health insurance. Drawing on nationally representative surveys and survey experiments, Ellis and Faricy show that social welfare policies designed as tax expenditures, as opposed to direct spending on social welfare programs, are widely popular with the general public. Contrary to previous research suggesting that recipients of these subsidies are often unaware of indirect government aid—sometimes called “the hidden welfare state”—Ellis and Faricy find that citizens are well aware of them and act in their economic self-interest in supporting tax breaks for social welfare purposes. The authors find that many people view the beneficiaries of social tax expenditures to be more deserving of government aid than recipients of direct public social programs, indicating that how government benefits are delivered affects people’s views of recipients’ worthiness. Importantly, tax expenditures are more likely to appeal to citizens with anti-government attitudes, low levels of trust in government, or racial prejudices. As a result, social spending conducted through the tax code is likely to be far more popular than direct government spending on public programs that have the same goals. 
 
The first empirical examination of the broad popularity of tax expenditures, The Other Side of the Coin provides compelling insights into constructing a politically feasible—and potentially bipartisan—way to expand the scope of the American welfare state.

Unskilled workers once flocked to Detroit, attracted by manufacturing jobs paying union wages, but the passing of Detroit's manufacturing heyday has left many of those workers stranded. Manufacturing continues to employ high-skilled workers, and new work can be found in suburban service jobs, but the urban plants that used to employ legions of unskilled men are a thing of the past. The authors explain why white auto workers adjusted to these new conditions more easily than blacks. Taking advantage of better access to education and suburban home loans, white men migrated into skilled jobs on the city's outskirts, while blacks faced the twin barriers of higher skill demands and hostile suburban neighborhoods. Some blacks have prospered despite this racial divide: a black elite has emerged, and the shift in the city toward municipal and service jobs has allowed black women to approach parity of earnings with white women. It is conventional wisdom that there is a grave crisis in our criminal courts: the widespread reliance on plea-bargaining and the settlement of most cases with just a few seconds before the judge endanger the rights of defendants. Not so, says Malcolm Feeley in this provocative and original book. Basing his argument on intensive study of the lower criminal court system, Feeley demonstrates that the absence of formal "due process" is preferred by all of the court's participants, and especially by defendants. Moreover, he argues, "it is not all clear that as a group defendants would be better off in a more 'formal' court system," since the real costs to those accused of misdemeanors and lesser felonies are not the fines and prison sentences meted out by the court, but the costs incurred before the case even comes before the judge—lost wages from missed work, commissions to bail bondsmen, attorney's fees, and wasted time. The apparently innocuous jokes, rituals, and nicknames prevalent within Little League baseball teams help establish how teams function internally and how they compete with other teams. Small groups also provide a platform for their members to engage in broader social discourse and a supportive environment to begin effecting change in larger institutions. In his studies of mushroom collectors and high school debate teams, Fine demonstrates the importance of stories that group members tell each other about their successes and frustrations in fostering a strong sense of social cohesion. And Fine shows how the personal commitment political volunteers bring to their efforts is reinforced by the close-knit nature of their work, which in turn has the power to change larger groups and institutions. In this way, the actions and debates begun in small groups can eventually radiate outward to affect every level of society. Although Americans are marrying later and single people feel lonely, few Americans report being socially isolated and the percentage who do has not really increased. Fischer maintains that this constancy testifies to the value Americans place on family and friends and to their willingness to adapt to changing circumstances in ways that sustain their social connections. For example, children now often have schedules as busy as their parents. Yet today's parents spend more quality time with their children than parents did forty years ago—although less in the form of organized home activities and more in the form of accompanying them to play dates or sports activities. And those family meals at home that seem to be disappearing? While survey research shows that families dine at home together less often, it also shows that they dine out together more often. Americans are fascinated by the quality of their relationships with family and friends and whether these bonds fray or remain stable over time. With so many voices heralding the demise of personal relationships, it's no wonder that confusion on this topic abounds. Thus far, the United States has a remarkable track record of incorporating new people into American society, but acceptance and assimilation have never meant equality. In Century of Difference, Claude Fischer and Michael Hout provide a compelling—and often surprising—new take on the divisions and commonalities among the American public over the tumultuous course of the twentieth century. Using a hundred years worth of census and opinion poll data, Century of Difference shows how the social, cultural, and economic fault lines in American life shifted in the last century. It demonstrates how distinctions that once loomed large later dissipated, only to be replaced by new ones. Fischer and Hout find that differences among groups by education, age, and income expanded, while those by gender, region, national origin, and, even in some ways, race narrowed. As the twentieth century opened, a person's national origin was of paramount importance, with hostilities running high against Africans, Chinese, and southern and eastern Europeans. Today, diverse ancestries are celebrated with parades. More important than ancestry for today's Americans is their level of schooling. Americans with advanced degrees are increasingly putting distance between themselves and the rest of society—in both a literal and a figurative sense. Differences in educational attainment are tied to expanding inequalities in earnings, job quality, and neighborhoods. Still, there is much that ties all Americans together. Century of Difference knocks down myths about a growing culture war. Using seventy years of survey data, Fischer and Hout show that Americans did not become more fragmented over values in the late-twentieth century, but rather were united over shared ideals of self-reliance, family, and even religion. As public debate has flared up over such matters as immigration restrictions, the role of government in redistributing resources to the poor, and the role of religion in public life, it is important to take stock of the divisions and linkages that have typified the U.S. population over time. The United States was founded on the principle of equal opportunity for all, and this ethos continues to inform the nation's collective identity. In reality, however, absolute equality is elusive. The gap between rich and poor has widened in recent decades, and the United States has the highest level of economic inequality of any developed country. Social class and other differences in status reverberate throughout American life, and prejudice based on another's perceived status persists among individuals and groups. In Envy Up, Scorn Down, noted social psychologist Susan Fiske examines the psychological underpinnings of interpersonal and intergroup comparisons, exploring why we compare ourselves to those both above and below us and analyzing the social consequences of such comparisons in day-to-day life. What motivates individuals, groups, and cultures to envy the status of some and scorn the status of others? Who experiences envy and scorn most? Envy Up, Scorn Down marshals a wealth of recent psychological studies as well as findings based on years of Fiske's own research to address such questions. She shows that both envy and scorn have distinctive biological, emotional, cognitive, and behavioral characteristics. And though we are all "wired" for comparison, some individuals are more vulnerable to these motives than others. Dominant personalities, for example, express envy toward high-status groups such as the wealthy and well-educated, and insecurity can lead others to scorn those perceived to have lower status, such as women, minorities, or the disabled. Fiske shows that one's race or ethnicity, gender, and education all correlate with perceived status. Regardless of whether one is accorded higher or lower status, however, all groups rank their members, and all societies rank the various groups within them. We rate each group as either friend or foe, able or unable, and accordingly assign them the traits of warmth or competence. The majority of groups in the United States are ranked either warm or competent but not both, with extreme exceptions: the homeless or the very poor are considered neither warm nor competent. Societies across the globe view older people as warm but incompetent. Conversely, the very rich are generally considered cold but highly competent. Envy Up, Scorn Down explores the nuances of status hierarchies and their consequences and shows that such prejudice in its most virulent form dehumanizes and can lead to devastating outcomes—from the scornful neglect of the homeless to the envious anger historically directed at Tutsis in Rwanda or Jews in Europe. Individuals, groups, and even cultures will always make comparisons between and among themselves. Envy Up, Scorn Down is an accessible and insightful examination of drives we all share and the prejudice that can accompany comparison. The so-called problem of immigrants on the dole was nonetheless a major concern of the 1996 welfare reform law, the impact of which is still playing out today. While legal immigrants continue to pay taxes and are eligible for the draft, welfare reform has severely limited their access to government supports in times of crisis. Leighton Ku looks specifically at trends in food stamps and Medicaid use among noncitizen children and adults and documents the declining health insurance coverage of noncitizen parents and children. Finally, Ariel Kalil and Danielle Crosby use longitudinal data from Chicago to examine the health of children in immigrant families that left welfare. Even though few states took the federal government's invitation with the 1996 welfare reform law to completely freeze legal immigrants out of the social safety net, many of the law's most far-reaching provisions remain in place and have significant implications for immigrants. As women moved into the formal labor force in large numbers over the last forty years, care work – traditionally provided primarily by women – has increasingly shifted from the family arena to the market. Child care, elder care, care for the disabled, and home care now account for a growing segment of low-wage work in the United States, and demand for such work will only increase as the baby boom generation ages. But the expanding market provision of care has created new economic anxieties and raised pointed questions: Why do women continue to do most care work, both paid and unpaid? Why does care work remain low paid when the quality of care is so highly valued? How effective and equitable are public policies toward dependents in the United States? In For Love and Money, an interdisciplinary team of experts explores the theoretical dilemmas of care provision and provides an unprecedented empirical overview of the looming problems for the care sector in the United States. Drawing on diverse disciplines and areas of expertise, For Love and Money develops an innovative framework to analyze existing care policies and suggest potential directions for care policy and future research. Candace Howes, Carrie Leana and Kristin Smith investigate the dynamics within the paid care sector and find problematic wages and working conditions, including high turnover, inadequate training and a “pay penalty” for workers who enter care jobs. These conditions have consequences: poor job quality in child care and adult care also leads to poor care quality. In their chapters, Janet Gornick, Candace Howes and Laura Braslow provide a systematic inventory of public policies that directly shape the provision of care for children or for adults who need personal assistance, such as family leave, child care tax credits and Medicaid-funded long-term care. They conclude that income and variations in states’ policies are the greatest factors determining how well, and for whom, the current system works. Despite the demand for care work, very little public policy attention has been devoted to it. Only three states, for example, have enacted paid family leave programs. Paid or unpaid, care costs those who provide it. At the heart of For Love and Money is the understanding that the quality of care work in the United States matters not only for those who receive care but also for society at large, which benefits from the nurturance and maintenance of human capabilities. As care work gravitates from the family to the formal economy, this volume clarifies the pressing need for America to fundamentally rethink its care policies and increase public investment in this increasingly crucial sector.

Since the 1960s, the dominant model for fostering diversity and inclusion in the United States has been the “color blind” approach, which emphasizes similarity and assimilation and insists that people should be understood as individuals, not as members of racial or cultural groups. This approach is especially prevalent in the workplace, where discussions about race and ethnicity are considered taboo. Yet, as widespread as “color blindness” has become, many studies show that the practice has damaging repercussions, including reinforcing the existing racial hierarchy by ignoring the significance of racism and discrimination. In The Color Bind, workplace experts Erica Foldy and Tamara Buckley investigate race relations in office settings, looking at how both color blindness and what they call “color cognizance” have profound effects on the ways coworkers think and interact with each other. Based on an intensive two-and-a-half-year study of employees at a child welfare agency, The Color Bind shows how color cognizance—the practice of recognizing the profound impact of race and ethnicity on life experiences while affirming the importance of racial diversity—can help workers move beyond silence on the issue of race toward more inclusive workplace practices. Drawing from existing psychological and sociological research that demonstrates the success of color-cognizant approaches in dyads, workgroups and organizations, Foldy and Buckley analyzed the behavior of work teams within a child protection agency. The behaviors of three teams in particular reveal the factors that enable color cognizance to flourish. While two of the teams largely avoided explicitly discussing race, one group, “Team North,” openly talked about race and ethnicity in team meetings. By acknowledging these differences when discussing how to work with their clients and with each other, the members of Team North were able to dig into challenges related to race and culture instead of avoiding them. The key to achieving color cognizance within the group was twofold: It required both the presence of at least a few members who were already color cognizant, as well as an environment in which all team members felt relatively safe and behaved in ways that strengthened learning, including productively resolving conflict and reflecting on their practice. The Color Bind provides a useful lens for policy makers, researchers and practitioners pursuing in a wide variety of goals, from addressing racial disparities in health and education to creating diverse and inclusive organizations to providing culturally competent services to clients and customers. By foregrounding open conversations about race and ethnicity, Foldy and Buckley show that institutions can transcend the color bind in order to better acknowledge and reflect the diverse populations they serve.

What specific social forces in each country account for the barriers immigrants and their children face, and how do anxieties about immigrant integration and national identity differ on the two sides of the Atlantic?

Western European countries such as Germany, the Netherlands, and the United Kingdom have witnessed a significant increase in Muslim immigrants, which has given rise to nativist groups that question their belonging. Contributors Thomas Faist and Christian Ulbricht discuss how German politicians have implicitly compared the purported “backward” values of Muslim immigrants with the German idea of Leitkultur, or a society that values civil liberties and human rights, reinforcing the symbolic exclusion of Muslim immigrants. Similarly, Marieke Slootman and Jan Willem Duyvendak find that in the Netherlands, the conception of citizenship has shifted to focus less on political rights and duties and more on cultural norms and values. In this context, Turkish and Moroccan Muslim immigrants face increasing pressure to adopt “Dutch” culture, yet are simultaneously portrayed as having regressive views on gender and sexuality that make them unable to assimilate.

Religion is less of a barrier to immigrants’ inclusion in the United States, where instead undocumented status drives much of the political and social marginalization of immigrants. As Mary C. Waters and Philip Kasinitz note, undocumented immigrants in the United States. are ineligible for the services and freedoms that citizens take for granted and often live in fear of detention and deportation. Yet, as Irene Bloemraad points out, Americans’ conception of national identity expanded to be more inclusive of immigrants and their children with political mobilization and changes in law, institutions, and culture in the wake of the Civil Rights Movement. Canadians’ views also dramatically expanded in recent decades, with multiculturalism now an important part of their national identity, in contrast to Europeans’ fear that diversity undermines national solidarity.

With immigration to North America and Western Europe a continuing reality, each region will have to confront anti-immigrant sentiments that create barriers for and threaten the inclusion of newcomers. Fear, Anxiety, and National Identity investigates the multifaceted connections among immigration, belonging, and citizenship, and provides new ways of thinking about national identity.

The U.S. labor market is the most laissez faire of any developed nation, with a weak social safety net and little government regulation compared to Europe or Japan. Some economists point to this hands-off approach as the source of America's low unemployment and high per-capita income. But the stagnant living standards and rising economic insecurity many Americans now face take some of the luster off the U.S. model. In America Works, noted economist Richard Freeman reveals how U.S. policies have created a labor market remarkable both for its dynamism and its disparities. America Works takes readers on a grand tour of America's exceptional labor market, comparing the economic institutions and performance of the United States to the economies of Europe and other wealthy countries. The U.S. economy has an impressive track record when it comes to job creation and productivity growth, but it isn't so good at reducing poverty or raising the wages of the average worker. Despite huge gains in productivity, most Americans are hardly better off than they were a generation ago. The median wage is actually lower now than in the early 1970s, and the poverty rate in 2005 was higher than in 1969. So why have the benefits of productivity growth been distributed so unevenly? One reason is that unions have been steadily declining in membership. In Europe, labor laws extend collective bargaining settlements to non-unionized firms. Because wage agreements in America only apply to firms where workers are unionized, American managers have discouraged unionization drives more aggressively. In addition, globalization and immigration have placed growing competitive pressure on American workers. And boards of directors appointed by CEOs have raised executive pay to astronomical levels. Freeman addresses these problems with a variety of proposals designed to maintain the vigor of the U.S. economy while spreading more of its benefits to working Americans. To maintain America's global competitive edge, Freeman calls for increased R&D spending and financial incentives for students pursuing graduate studies in science and engineering. But while this has some cost in unemployment and higher taxes, carefully designed social safety nets do not seriously jeopardize economic efficiency. Working Under Different Rules is an illuminating analysis of the often complex interaction of market institutions, social policy, and economic results. The American economy is in danger of leaving its low-skilled workers behind. In the last two decades, the wages and employment levels of the least educated and experienced workers have fallen disastrously. Where willing workers once found ready employment at reasonable wages, our computerized, service-oriented economy demands workers who can read and write, master technology, deal with customers, and much else. Improved education and training will alleviate this problem in the long run, but educating the new workforce will take a substantial national investment over many years. In the meantime, we face increasingly acute questions about how to include low-skill workers in today's economy. Generating Jobs takes a hard look at these questions, and asks whether anything can be done to improve the lot of low-skilled workers by intervening in the labor market on their behalf. These micro demand-side policies seek to improve wages and employment levels—either by lowering the costs of hiring low-skilled workers through employer subsidies, or by raising wage levels, benefit levels, or hours of employment, or by providing employment via government jobs. Although these policies are not currently popular in the U.S., they have long been used in many countries. Generating Jobs provides a clear-eyed assessment of this history, and asks if any of these policies might be applicable to the current problems of low-skilled workers in the United States. The results are surprising. Several recently touted panaceas turn out to be costly and ineffective in the American labor market. Enterprise zones, for instance, are an expensive way of moving jobs into areas of high unemployment, costing as much as $60,000 per job. Similarly, job-sharing, which has had uneven success in Europe, turns out to be ill-suited to conditions in the U.S., where wages are relatively low and workers need to work long hours to maintain income. On the other hand, a number of older, less flashy policies turn out to have real, if modest, benefits. Wage subsidies have increased employment among qualifying workers, and public employment policies can increase the number of workers from targeted groups working during the program. While acknowledging that many solutions are counterproductive, this definitive review of active labor market policies shows that many programs can offer real help. More than any rhetoric, Generating Jobs is the best guide to future action and a serious response to those who claim that nothing can be done.

From a dive bar in New Orleans to a leafy residential street in Minneapolis, many establishments and homes in cities across the nation share a troubling and largely invisible past: they were once sites of industrial manufacturers, such as plastics factories or machine shops, that likely left behind carcinogens and other hazardous industrial byproducts. In Sites Unseen, sociologists Scott Frickel and James Elliott uncover the hidden histories of these sites to show how they are regularly produced and reincorporated into urban landscapes with limited or no regulatory oversight. By revealing this legacy of our industrial past, Sites Unseen spotlights how city-making has become an ongoing process of social and environmental transformation and risk containment.
 
To demonstrate these dynamics, Frickel and Elliott investigate four very different cities—New Orleans, Minneapolis, Philadelphia, and Portland, Oregon. Using original data assembled and mapped for thousands of former manufacturers’ locations dating back to the 1950s, they find that more than 90 percent of such sites have now been converted to urban amenities such as parks, homes, and storefronts with almost no environmental review. And because manufacturers tend to open plants on new, non-industrial lots rather than on lots previously occupied by other manufacturers, associated hazards continue to spread relatively unabated. As they do, residential turnover driven by gentrification and the rising costs of urban living further obscure these sites from residents and regulatory agencies alike.
 
Frickel and Elliott show that these hidden processes have serious consequences for city-dwellers. While minority and working class neighborhoods are still more likely to attract hazardous manufacturers, rapid turnover in cities means that whites and middle-income groups also face increased risk.  Since government agencies prioritize managing polluted sites that are highly visible or politically expedient, many former manufacturing sites that now have other uses remain invisible. To address these oversights, the authors advocate creating new municipal databases that identify previously undocumented manufacturing sites as potential environmental hazards. They also suggest that legislation limiting urban sprawl might reduce the flow of hazardous materials beyond certain boundaries.
 
A wide-ranging synthesis of urban and environmental scholarship, Sites Unseen shows that creating sustainable cities requires deep engagement with industrial history as well as with the social and regulatory processes that continue to remake urban areas through time.

The authors find that size of place is a critical demographic factor, affecting population composition (rural populations are older and more predominantly male than urban populations), the distribution of poverty (urban poverty tends to be concentrated in neighborhoods; rural poverty may extend over large blocks of counties), and employment opportunities (job quality and income are lower in rural areas, though rural occupational patterns are converging with those of urban areas). In general, rural and small town America still lags behind urban America on many indicators of social well-being. Or at least, that's what politicians on the right and left often tell us, and what the American public largely believes. But sociologist Frank Furstenberg argues that the conventional wisdom distorts reality. In Destinies of the Disadvantaged, Furstenberg traces the history of public concern over teen pregnancy, exploring why this topic has become so politically powerful, and so misunderstood. Based on over forty years of Furstenberg's research on teen childbearing, Destinies of the Disadvantaged relates how the issue emerged from obscurity to become one of the most heated social controversies in America. Both slipshod research by social scientists and opportunistic grandstanding by politicians have contributed to public misunderstanding of the issue. Although out-of-wedlock teen pregnancy rose notably between 1960 and 1990—a cause for concern given the burdens of single motherhood at a young age—this trend did not reflect a rise in the rate of overall teen pregnancies. In fact, teen pregnancy actually declined dramatically in the 1960s and 1970s. The number of unmarried teenage mothers rose after 1960, not because more young women became pregnant, but because those who did increasingly chose not to rush into marriage. Furstenberg shows how early social science research on this topic exaggerated the adverse consequences of early parenthood both for young parents and for their children. Researchers also inaccurately portrayed single teenage motherhood as a phenomenon concentrated among minorities. Both of these misapprehensions skewed subsequent political debates. The issue became a public obsession and remained so during the 1990s, even as rates of out-of-wedlock teen childbearing plummeted. Addressing teen pregnancy was originally a liberal cause, led by advocates of family planning services, legalized abortion, and social welfare programs for single mothers. The issue was later adopted by conservatives, who argued that those liberal remedies were encouraging teen parenthood. According to Furstenberg, the flexible political usefulness of the issue explains its hold on political discourse. The politics of teen parenthood is a fascinating case study in the abuse of social science for political ends. In Destinies of the Disadvantaged, Furstenberg brings that tale to life with the perspective of a historian and the insight of an insider, and provides the straight facts needed to craft effective policies to address teen pregnancy.
